      Sent the Account Sold in Dispute letter to 1st Credit (who now own the Halifax account) and they have replied by titling the letter
      Bankruptcy Proceedings Being Considered
      and then goes on to say
      "we are unaware of any legally valid reason for non-payment of the outstanding debt or of a reasonable offer being made. We are therefore considering whether we should issue a statutory demand under the Insolvency Act 1986"

      It lists the implications of being made bankrupt and finishes with
      "if you wish to avoid the possibility of the above proceedings taking place then we would recommend you contact us to pay in full".

      So they've completely ignored that this account is in dispute and told me they wish to make me bankrupt. That's lovely of them. So what should I go back with, as they're obviously playing hardball? And should I next day delivery the letter to get to them before Christmas or wait until after?

        Which letter (if any) should I send to 1st Credit in response to the Bankruptcy Consideration letter?

            Hi - looking at post 1 you never provided much details on this - please clarify the basic info we require...
            • Type of account (credit card/loan)

            • Date commenced (ideally before Apr 2007)

            • Approx balance

            • Date last paid (approximate date you last made a FULL payment)

            • Are you on arrangement or not paying

            • Status (default/in arrears/up-to-date)

              Regarding Robinson Way for Marbles #124, they have written saying the account is being closed and sent back to the client. Great!

              As for Lewis Group for Barclays overdraft #128 who last said they were passing the account over to a field agent to discuss the matter with me, well yesterday they paid me a visit (I was at work) and not content with ringing the doorbell, they banged on the door waking up my son from a lunchtime sleep and severely pissing off the wife. The 'field agent' then asked if I was in to which my wife said I wasn't. He then handed over a small envelope which contained a card that says

              'Our representative called today to discuss an important matter with you concerning client Barclays Bank PLC. Please contact our agent to arrange a convenient date and time to resolve this matter. Contact our agent urgently to avoid any possible further recovery action.'

              Then on the back, he has handwritten

              Bal £1337-13
              Repayment Plan £20 Month
              Please call me to discuss

              So they've finally come round the house and literally hammered on the door. F*ckers. For this overdraft, I haven't received any termination notice, any default notice, no statement of account and now have collectors hounding me at my house. I would agree to a repayment of £20 a month, but only if I have first reduced the balance way down. Any advice for the next step?

                        If they continue to pester you I still have my file which I built up when they tried the same crap with me over a Citibank CC. It cost them a FOS Complaint and Compensation to me

                          After a reasonable period of hassle-freeness, I've had a letter regarding my Barclays overdraft.
                          It was previously with Lewis Group who specialised in sending an agent round a few times, but usually went away without a fight. After ignoring various letters and threats, this account must have gone back to Barclays, who have now brought in Moorcroft DCA.
                          Their letter which I received yesterday was the standard affair - "introduce ourselves" "outstanding debt" "must pay this immediately or we may proceed with further recovery procedures".

                          I guess my first port of call is ignore and see what follows?

                              After ignoring numerous letters and even more numerous telephone calls from Moorcroft regarding my Barclays overdraft, including a 'generous' £80 per month repayment scheme, I've had a letter today from Midas Credit Services. On behalf of and part of the Moorcroft Group, they are recommending possible further recovery action unless an agreement on settlement of the account is made.

                              Shall I see what comes next or try their hand with the o/d CCA request?
