    08-04-14 Letter received from Clarity, I previously advised them that the account was in dispute regarding my CCA request, they have now sent me a copy of my application form and a separate set of generic Terms & Conditions, I think I will respond with “CCA missing prescribed Terms” template.

    08-04-14 Letter from Marlin along with copies of all my previous statements relating to the card, and inform me that they are still awaiting a copy of my CCA. So I won’t respond to this and see what they come up with next.

    *Interestingly I also received a letter from Capquest also informing me they have bought my Lloyds TSB account, I was initially confused by this as Marlin only recently bought it off Lloyds TSB Banking, and it also shows a different card account no. and outstanding amount, on looking back at my files the account number and outstanding amount relates to my Halifax Visa card account not my Lloyds Visa, so it looks like they have their wires crossed on this one, anyway I have sent off a new CCA request so I’ll see what they come up with (incidentally I have a previous letter from a couple of years back from Halifax stating they could not supply my CCA and therefore would not attempt to enforce the alleged debt via the courts, I think I’ll keep this under my hat for a while and see what Capquest’s next move is)

    I responded with the missing prescribed terms template and I’ve no word from them until now.

    As it is one of the bigger accounts that I’m fighting I want to make sure I respond correctly to their letter, not yet sure with what though to be honest. !
    08-04-14 Letter from Cabot telling me they have once again complied with my CCA request, Quote” We will no longer correspond to letters of this nature, as the matter has been addressed therefore the dispute has been resolved and we are returning your account to our “Customer Operations Dept.” Unquote

    Not sure how I will respond to this right now, maybe a “final response” template letter? Cabot have had this account now since May 2011 and I’ve been playing letter “ping pong” with them ever since, so it looks like they are not going to go away easily…

    Just a couple that need addrssing...

    Capitol One Card (UE)

    Account passed around a couple of DCA's, but now owned by Cabot


    9th December 2011- Another letter received from Cabot insisting the Capitol One credit application form and T&C are fully compliant and the account is enforcable, so this matter cannot continue to go on, I must contact one of their helpful customer advisers to discuss the options for repayment of this debt !
    3rd April 2012 - Letter from Cabot,insisting once again that they have fully complied with my s77/78 request by providing the correct documentation.
    I responded and advised them that an application form that does not encompass all the T&C is not a compliant CCA, so I still consider the account in dispute.

    16th April 2012 Letter from Cabot stating "Last chance to agree a suitable repayment plan before we move your account to our Pre Litigation Dept"
    2 May 2012 Letter from Cabot - " You account has now been escalated to our Pre Litigation Dept. If we don't hear from you, we will make a decision on what the next stage of recovery to pursue, this could be County Court Judgment, Charging order on your property, attachment of earnings order, Order to Obtain Information - you may have to attend court to be questioned under oath by a court officer..
    Alternatively we may instruct an External Debt Collection Agency or Legal Agency to call on you"


    Judging by the rapid response by Cabot in replying to my letters, it looks like they are digging their heels in on this one and moving fast through each stage, so not sure what my next move will be yet....

    Not had much stress from Cabot on this account for quite a while, now received a letter advising me that despite my continual insistence that the account is in dispute with the OC Capital One, they have been advised by Capital One that they fully complied with my 77/78 of the consumer credit act 1974 and issued a final response to me in this regard on the 2 August 2010.
    So in conclusion they consider me liable for the repayment of the account.

    Cabot go on to say they have assigned the account over to Wright Hassall Solicitors who will contact me to discuss repayment options available to me.
    Had no previous dealings with Wright Hassall…hope they don’t live up to their name and become a “Right Hassle” ……

    Cheers niddy, I was thinking along the lines of a new cca request ..I do prefer to keep a paper chain going rather than ignore, especially when a new "playmate" joins my fan club base....

    Never did hear anything back from Debt managers so they must have decided it was a lost cause and passed it back to Arrow Global and it's been quiet on this account since then.

    However yesterday I received a letter from Arrow Global notifying me that they have now assigned Clarity to administer the account on their behalf, I'm not going to respond to Arrow Global and will wait to hear from Clarity and then respond to them accordingly.
