Yep Elsa tried the new uploader and it works a treat.....sadly this CCA on first inspection by the boss it appears..

But hey you don't be worrying about your Halifax one,..all our situations are different, and besides maybe they think they have won the battle on this one of mine ...but they sure as hell have not won the war yet.....

Bank One are also providing ENFORCEABLE agreements. Although HBOS said they'd not enforce; it seems that now they're finding the originals and so far they are good.

Buggery. I'll find a fault - but for now Allan needs to issue missing PT's to buy us time.

August 14th letter received from Halifax, stating as they have been unable to supply reconstituted version of my original agreement they will not seek to enforce the agreement through the courts as defined in the case McGuffick v RSB, however, even if unenforceable the contract still has a legal effect and is not void, the lender is merely prevented from seeking an enforcement order from the court.
September 8th letter received from Albion Collections, the lender has told us they are taking further action to recover the amount owed, this could include legal action, and a debt collector may visit my home to collect the debt!
To Date not responded to this letter.
Well somewhat disappointed by receiving a couple of letters regarding the above account, not heard anything for a over 3 years since Halifax informed me they would not enforce this alleged debt unless they could supply me with my CCA. Now Lloyds Banking Group who took over the Halifax business have sold the debt to Capquest, who have managed to a get a copy of my CCA from Bank One (the original issuer of the card before it became a Halifax card.) So I have now got a CCA and a letter of Pre Litigation Action if I do not pay up or arrange a payment plan !

I think this needs some quick action before it develops into a bad situation..I will let Niddy look over the CCA before I respond to Capquest...

    Update 17-07-14

After being away working overseas for the last 6 weeks as usual I always get a bit nervous as the time approaches to come back home and wonder what nasty letters might be awaiting me... well on this occasion only a couple. One regarding my Monument credit card account, which to date (4 yrs) I am still awaiting them coming up with a CCA, their latest letter says they are prepared to offer a 50% discount off the alleged outstanding debt of £5K. I think I will just keep waiting for the arrival of my CCA before considering their offer.....

The other from Capquest in reference to my Lloyds TSB Visa, (£13K ) needs a little more consideration before I respond as Capquest have now supplied a copy of my CCA & T&C.
Niddy considered it UE when he looked at the CCA that Lloyds sent me 4 yrs ago, I can't remember why it was UE so may be it will be wise to let Niddy take another look just to refresh him on the agreement content before I reply.

    Lloyds TSB Visa

To-day I have received a letter from Lloyds informing me that they have sold all rights title and interest in the account to MARLIN EUROPE II LTD... and Marlin have assigned Capquest to handle the account.

Not liking this as Marlin/Capquest have a reputation for being particular aggressive. So just have to wait and see what they have to say when they write to me, which I imagine won't be long in happening...

I think this is because Halifax Bank of Scotland is now owned by Lloyds Banking Group. I just have to take a deep breath and pay close attention whenever I get anything from Capquest now, but I was also thrown by this when reading one of their letters in a hurry.

I can agree happily (almost!) about the diminishing number of letters though -- I just got back from three weeks overseas and was expecting a ton of letters to deal with on my return (to the point where I was concerned that three weeks away was too long to be away without dealing with the debt admin) but in that time I had only been sent a single "We are still awaiting documents from our client" letter from the whole of my delightful debt portfolio ...
    Hi Pip,
Yes when I thought more about it Lloyds Banking Group did take over Halifax so that will explain why they are now referring to old Halifax accounts as Lloyds Group.
My overseas work takes me away for 6 weeks at a time so I always start to sweat a little as the time approaches for coming home, but I am relieved to find less and less letters awaiting my return. Still got another two years to go before I'm SB on the alleged debts, so not out of the woods yet....

*Interestingly I also received a letter from Capquest also informing me they have bought my Lloyds TSB account, I was initially confused by this as Marlin only recently bought it off Lloyds TSB Banking, and it also shows a different card account no. and outstanding amount, on looking back at my files the account number and outstanding amount relates to my Halifax Visa card account not my Lloyds Visa, so it looks like they have their wires crossed on this one

Less and less "Fan Mail" waiting for me when I get back these days, I used to come back to more than a dozen letters.
