  • Re: New and confused

samsmum, don't let these idiots make you feel like that in your own home.

As in 2 deep says, more often than not they are just empty threats and they don't turn up; but even if they do, just treat them like you would a door-to-door salesperson - ignore them or tell them to go away and shut the door.

They have no power, none, ditto, diddly squat! They cannot come into your home (well unless you wanted to invite them in and provide afternoon tea). They are just chancers - please remember that and you'll be fine

Thanks Diddlydee. Whilst i do still take our debts seriously thanks to the support on here i now realise that they dont make me a bad person and i dont need to feel ashamed. Spent enough years thinking that way. Would've carried on chipping away at the debts but circumstances change and the way i deal with them and think about them has to change too. My opinion of dca's etc has certainly changed!!

Just a general comment samsmum for others reading if you don't mind. I always send a "doorstep" letter to the perpetrator the moment it is mentioned in any correspondence. This shuts off completely ANY legal excuse for them to come to your door. If they do come then it is they who have infringed the law and committed the Tort of Trespass for which you are entitled to financial redress. You won't get that easily but legally puts you in the driving seat. Their implied licence to visit under Common Law has been revoked. End of. Have a suitably doctored copy behind your front door to give to any unfortunate who comes, give it to them, and slam the door in their faces. They must leave your property with all haste.

Cheers for that Garlock. Niddy advised me to send one off on Monday but wasn't sure it would get there as they didn't give me much notice. Like your idea of keeping a copy handy. All these tips and tools give me a bit of confidence in dealing with all this. Never thought i'd stick it out to be honest so surprised myself. Their 2 debts are UE as well so all good.

            Thanks again

Back tracking, Co-op is a fixed term loan, yes? dates back to Nov 2002, yes? terminated by them Sept 2011 yes?. Dmp for, stopped paying and not heard for "years, yes?

Right, this will be a regulated agreement and as they want to play hardball send this:-

                          Unenforceability Templates - Section 1
Attach a £1 postal order, sign nothing.

Was there ever a default notice under section 87(1) of thre CCA1974. The commencement date gives you the protection of section127/s61 of the Act. you say not heard anyhting for "years". To keep the account alive they have to send at the very least an anuual statement of account to your last known address. The dN will hgave to be fully compliant and they cannot terminate on a defective or no DN. They are in default until they do issue a compliant DN and cannot isue proceedings during this time. They would be foolish to do so.

See what they send from the CCA request and they have only 12 + 2 days to respond. Give an extra week and then we can move onto the next phase.

Yes that's all correct. £5000 loan taken out in 2003 with £2,654 interest and £1,188 ppi added. Now owe £4,100. Stopped paying a couple of months ago after 8 years on dmp. No default showing and never receive statements from them
