They want payment proposals within 14 days. What letter do I send to them now, please tell me there is a nice stroppy one out there for them ;LOL ;LOL

    Thanks as always
Hiya, nope - you've completed communication - now you need them to take further action so you can argue with whoever/whatever action they decide on next! Just sit tight with this for the time being.... ;-)[/quote:24jam8d5]

Niddy, hope you don't mind but got a question about our o/draft.

We went for charges as the account stood at £5064 and £4407 of that is made up of charges. They have refused to refund charges and we have been sending letters back & forward to Apex, who were dealing with it. We sent a letter in August saying that we could not pay full amount but could pay the amount left after the charges had been taken off, never heard back from them.

Today got a letter from SCM listing court costs and that unless we pay within 7 days they will start court proceedings. Any advice on how to proceed with this would be great. Thought about sending copy of letter sent to Apex and asking SCM to consider this offer again. Sorry to be bugging you when you are busy with the site. Cheers

          Hiya,

I'd send this right now - just to buy you some time: ---> viewtopic.php?p=2319#p2319

I know it is not entirely relevant but at least it gets them to sit up and pay attention to the fact something isn't right, they should also return the account to Apex. have you now gone to the FOS regards reclaim? It may be best to start a reclaim thread here: ---> viewforum.php?f=42

I'll then ask Di (resident 'reclaim' expert) to come and look at your reclaim query as she'll be able to offer better advice, but in the meantime send the template above to SCM and start a new thread as directed above.... we'll find you, don't worry about that!

Hmmm, you need to speak to Di - start a thread with only the reclaim element and see what she says - when you do it i'll ask her to come look.

Got a letter from Iqor today, it is for the BOS Preference Acc. This had been with Apex, but had not heard from them since August.

Iqor want the usual, immeidate payment or will send someone round, or they might start legal proceedings. Did notice on the letter that they say the debt is to Capital Bank not BOS not sure what that means ;Hmm

Will send out Account Sold while in Disupute letter to them and also incorporate Telephone Harrass letter, hope that is ok.

Hi everyone, hope you are all having a good weekend and not toooo much snow!!!

Letter from Iqor today ref the Account in Dispute letter I sent out in October. They have done a complete investigation into my complaint and are concerned that I had to complain in the first place - bless

Anyway they say that they contacted HBOS and they replied with 'Our Customer Relations Dept has issued a final response letter to you as a copy of your agreement was sent.

Should you have any further queries to contact their Contact Relations Dept, the letter we sent was in May 2010 and no further contact had been made to date.'

They have taken our telephone number off, so they listened to that part of the letter. They state in the letter that 'they acted in good faith and on our Client's instructions in our attempts to collect the balance that our Client believes to be outstanding. Please contact us with your repayment proposals or advise us how you intend to deal with this matter.'

I notice they said that it is a balance that our client BELIEVES to be outstanding, thought that was interesting. They have put the account on hold for 2 weeks for us to contact them, what would be the best letter to send out next Niddy?

                  Thanks Mrs SNS

Morning all, making up for all the letters we have not had for 2 weeks. Green & Co have written back about the Mint acc. It says that they have not yet received full instructions and have passed our letter to Triton. So will wait and see what Triton have to say when they get in touch.[/quote:4y4hwko3] LOL, so Try-it-On were bluffing then? Lets see what happens [/quote:4y4hwko3]

Ok doke after sending out Niddy's response have now got a letter from Moorcroft about our Mint CC, so looks like Try-it-on have passed it to them. Letter says 'It is a legal requierment to send a notice of intended litigation before legal proceedings in the County Court are issued. We believe that this letter fulfils this rwequirement if it is not actually read by you'

If we do not contact them by 14th they 'may' issue a claim without further notice.

Do I send out 'Threat of Legal Action' letter? Thanks

Also got another letter from Apex today, exactly the same as the one I got yesterday, they must be very bored at the moment ;LOL ;LOL , it was even dated the same day as well ;D[/quote:1jug47hm]

Opening the next couple of letters, looks like Apex have given up and this has now been passed to Robinsons Way. Two letters from them today, one is a Security Message saying that recent actions on your account are giving cause for concernand I should call them - that will be a big NOOOO!!!

Second letter from them is a Formal Demand for Payment, we have 10 days to pay this account if not court action etc etc. Will send out Account Sold in Dispute letter, hope that is okay.

                                Cheers Niddy [/quote:1jug47hm]

Also got letter from Rob Way about LLoyds. Just a letter telling us to act now and pay up basically, do I just leave this?

At least the snow is melting :yeah :yeah
