    Yep, just ignore for the moment

      hiya n-i-d
      i have looked at my credit report and it shows a default from halifax dated the 13/10/2010 i have not recieved any letter from halifax to regards to defaulting my account or any time to rectify the account ( this is the account i am blagging) i have also not paid anything to this account since march 2010 thanks n-i-d

        Hiya

        A default is expected, but being they have not notified you this is grounds for appeal to set-aside any judgment they may attempt......

        Just sit tight, don't chase them and do their jobs for them!

              i have recieved a letter from debt managers ref my barclay card
              quick recap they sent me my application form with no prescibed terms or con on it they say in a letter that all t's and con's were on the reverse side of the appliction they sent but have never sent that side if the agreement so i don't know if they are telling the truth on that one .
              letter says....
              further to our letter dated 24/11/2010. Our client have confirmed that they have fulfilled their obligation under section 78 of the consumer credit act 1974, on the 16/06/2010 , and they do not consider the account to be in dispute.
              the full balance is now due, please contact our offices to arrange repayment of the outstanding debt.

              They have also sent an income and expenditure form for me to fill in

                Just ignore it and don't fill in no I&E sheet either!

                  Basically there are NO prescribed terms attached, there is also no separate agreement for the PPi (in line with s.18 CCA1974) nor is there any link to cancellation rights. Put simply it is a blass-up of an application that holds no legal weight in court!

                  If for any reason they went to court and did win *gasp in horror* then i'd be saying reclaim all PPi and charges which would knock 50% + off the debt anyways!

                  However before we commence these proceedings, you have one final opportunity to make payment of the above account with in the next seven days. please make cheques payable to trition . should our client not recieve payment or acceptable proposals within the next seven days it will be assumed that you will not settle this matter amicable and reasonable terms. we are likely to be instructed to commence court proceedings against you on our clients behalf.

                        this account was passed to debt managers who ask me to arrange payment and fill in an i & e form which on you advice i didn't .
                        letter says .......

                        quite nice to recieve a letter that is not bullying or theatening but as i only have 2 bob and a conker i am not in the position to take settlement so should i ignore ? thanks n-i-d in advance

                            Brilliant Carol!

                            I had the same with a NatWest one, Green&Co handed it back to Triton who carried on for a bit and it's now with RMA. So . Triton may still pester you.

                            Green &Co seem to give up very quickly don't they! Mind you I think it's one solicitor squatting in a branch of NatWest .

                            Niddified and proud!

                            Fought and won the UE battle, thanks to Niddy and this forum...
                            SB since 2016. Now have my life back!

                                i have recieved a letter from robinson way limited ref my halifax credit card
                                quick recap... blagging as terms and cons are not 100% linked to application form
                                sent first letter to halifax 25/03/2010 requesting cca and letters have been backwards and forwards.
                                and i stil have not recieved a default notice or any time to rectify the situation showing on credit expert account was defaulted 04/10/10
                                it says....
                                appointment for home visit
                                your debt is still unpaid in spite of previous letters and calls. before court action is considered we may arrange a local collector to call at your address, to agree an affordable payment plan with you.
                                they also give there email address just inase i would rather contact them via email
                                and thats it !
                                i would assume i just ignore for now
