    I have sent a separate cca request for myself, I am still waiting on this information. So I will be sending for the wife with this to Tesco?

        Unless I've misunderstood, you received a letter from Moorcroft in October 2016 which states that Creation Finance admit that they don't have your credit agreement.

        Was that letter sent in response to a formal s 77-79 CCA Request ?

        I'm pleased that Lowells haven't written to you since but if they do write post on your thread and it may make sense to reply letting them know the account is currently unenforceable (have you kept that Moorcroft letter?).

        Letter dated 17th July Lowell Financial

        I have now received a letter lumping 3 accounts together (again), I have 6 letters previous to this. But this one is assessing my accounts for legal action, one of the accounts I am actually paying off with them. One is UE as previously mentioned, the other I cannot remember if I CCA'd or not. I have had no letters this year other than one I am going to up load shortly that relate individually to any accounts that I aren't dealing with.

        Di, has previously mentioned that I need to let them know that one of them is UE, how best would I do that?

        Is it common to get letters that lump accounts together?

          I cannot remember whether I ever CCA'd this account. Since this notification, I haven't received any letter relating to this, when hasn't been grouped with other accounts.

          Ok, it appears that I have CCA'd this, received a letter from Robinson Way date May 2017

          We write to confirm that we have noted the dispute/query that you have raised.

          We will make the necessary enquiries and let you know the outcome in due course. in the meantime we will stop all collection activity on this account.



          I guess I will need to SAR this as it appears to have gone, to AIC, Robinson Way and now to Lowell. I did do a CCA request in September 2016 to AIC, requested signed for just input reference no. into track and trace, giving me a error message, guess it is going back too far!

          • Just out of curiosity, is there an argument to SAR all debts that we have (then it is done)? Not totally sure how it all works, massive learning curve this.

            • Hi Strepsi,
              I have done exactly this with all mine, however mine have been going on for two years thus far with letter tennis so imo you don’t need to do it straight away as remember any communication that they have with the OC’s will be logged to the account also so if you jump too soon you may miss a piece of information that would be beneficial to you later- such as what documents have been requested by and passed to the DCA/solicitors.

              What I can tell you is this, whilst it may be very daunting at the outset for you the longer it goes on the more you learn and the more you see it for what it is the more you relax, you are surrounded by a wealth of knowledge and support here so you are not alone in your endeavour and if you feel stressed or can’t cope then post your fears and I’m sure someone on here can help you deal with it.

              • My own view is that sending SARS to everyone just means you have several filing cabinets full of papers and a small forest has been destroyed. With 20+ debts I have only ever sent 1 SAR and that was when they issued a claim against me. I found CCA's were enough- as it was I have one filing cabinet full of letters.

                • Just to add that, normally one would only send a SAR where the account has been sold on and the debt purchaser is getting really heavy. In those circumstances it is then useful to have all the information in the original creditor's file.

                    Thanks for the replies on this, I have a feeling that at some point it is going to heavy, all debts have now passed on to a dca one way or another. So I maybe investing in a filing cabinet!

                      • Well the obvious action is to send a SWID to Lowell . I wouldn't be specific either about which CCA, Don't do DCA's work for them.

                          Yes you could send a SWID letter however, from.personal experience Lowell may just source the agreement. Remember as well, a recon is sufficient as a cca is for info only and not proof.

                          I am not sure how a judge would feel about non compliance from the previous owner.

                          Of course a SWID might just get Lowell to return the debt to creation.

                          Technically the account is not in dispute if you follow FCA rules as disputes are supposed to be real issues as to if the debt is yours and the amount is correct.

                          I am just trying to explain the situation.

                          By the way, have they lumped the three accounts together under one reference number or have they quoted three account numbers.

                          To be honest without seeing the exact wording of the letter I can not say what I would do. Remember any letters you send could end up in a court bundle before a judge.

                            Top right hand side of letter, has three accounts with their reference no's. As mentioned one of these accounts I have an arrangement with them to pay and one is UE (Niddy).
