        Ok that is a recon, regardless of the content and form, they have clearly cut and pasted elements and admitted it in their cover letter (thus I asked to see this as they HAVE to admit when they use a recon). This means it is Unenforceable so respond with this: ---> viewtopic.php?p=1624#p1624

        Let us know what they come back. I've not suggested sending the fraudulent copy version of this template cos right now it is hard to apportion such blame, in that you could have completed the forum in a branch of N&P with the advisor completing it - so lets not throw accusations right now, keep those for later....

        Its 22 years old, no chance will they have the original - interesting to note the apr back then was 23% ;EEK

                Yea please send it over with their cover letter too.... Sometimes they send a recon if terms so I like to check to be certain the reply I give is accurate...

                      MBNA Visa - this is enforceable, the terms are down the right hand side however as it is MBNA - blag it and respond as follows: ---> viewtopic.php?p=1503#p1503

                        MBNA OK I will send the letter.

                        HSBC I have recieved a pack with terms and conditions. A blank application form, and nothing else, the cover letter is just waffle, I will send it for you to look at.

                          This means little, there is no CCA so it remains unenforceable until such time they do find it - which we already know, they can't (the account is way too old, i.e. over 20 years).

                          Just ignore their last letter, keep us updated if/when they write to you.

                            Hi Niddy,

                            I have received 2 letters from BOS today.

                            Letter 1 - I am now in in default and my account has been closed, it will now be passed on to a DCA.

                            Letter 2 - A very nice letter with a paragraph saying "We will not seek to enforce the agreement".

                            We can now safely say that this is :UE

                              Yey!! Nice one, well done. As I tell everyone the debt does exist and they will hassle you but do not back down. They cannot touch you. Just keep us updated when they sell it etc, it's not the end of it - sorry to say, but you can forget about it cos it's unenforceable and remains so until they find your agreement (or create a new one)!!

                                Its been all quiet this week, just one letter from MBNA with " its not too late to remove your account from restriction before you get a default" bearing in mind it has been in restriction for about 10 months after refusing to accept a interest rise hike. Just default and it get on with it its too late now. Heard nothing at all from Santander since I requested the CCA.
