    Does this mean last paid HBOS full payment or last paid any kind of payment (i.e. reduced sums to DCA). Sorry for being so thick trying to get head into gear with all this info.

    I bet there is hundreds maybe thousands of poor people like ourselves out there, we were the same all kicked off 2008-2009 haven' t paid HBOS for about 3 years now in total and then all of a sudden they sold to 1st Credit end of last year. They also sold the other CC about two years ago, but held on to the other CC and Pref Account, why we'll never know.

    Now we need to wait and see who raises there ugly heads next and be ready with the giuillotine to chop them off again (With Niddy's help hopefully)

    Good luck to you in your fight against them, hopefully together we can deal with this lot of crap once and for all.

    I also owe HBOS group (BOS,HBS & LTSB) over £40K and havent paid a penny for almost 2 years now as they are all deemed UE - not counting any chickens or anything yet - BUT long may it last.

    They must be in real do do and have one hell of a bad debt provision, if two customers alone owe em the best part of £100K in unenforecable debt - how many more similar to us are out there ? - many I would have thought.

    Lets all just remember we're a long way from anywhere - all we've achieved so far is getting two accounts returned to the OC who will no doubt come after Miss Muddles with a vengeance so we're gonna have a wee bit of a fight on our hands yet however it'll be fine as I'll stay with this one and respond to most posts as I want to ensure things are dealt with properly and the way 'I' choose not the way HBOS want to go!

    I'm not trying to scare you but lets remember who it is we're dealing with here, other than one of the most inept banks that exist, we're dealing with people that will flog this dead duck for a pittance to whoever will buy it thus we may bump into some nasty bastards along the way, but the good thing is I have dealt with them all before and will pretty much sort you with specific templates to send off to get rid early doors as I still have the main basis of complaint from 1st which can easily be edited and used to respond....

    All we want is for the OC to be lumbered with it then we can pretty much forget about it and wait out the 5yrs SB timeframe (rightly or wrongly).

    All the above in mind, don't worry - you'll be just fine and continue to enjoy this peace and quiet

    Your guidance in the direction of Sir Nid was an incredible rescue mission...French Resistance saved lives and thats exactly what you done, helped save my Hubby's life, how will we ever repay you, Niddy and AAD.

    Why? Easy...

    Look at the agreement - what is the obvious error - look right at the very top? What is this 'page' exactly cos it aint a credit agreement regulated under the CCA1974 that's for sure ergo this is toilet roll right now and no matter what they do they will never be able to enforce this as there are no enforcement rights for such a breach, well there are but we'll get Paul on the case who will batter them into submission.

    Kiss bye bye to that visa and mastercard - they're now dead as far as I am concerned.

    Oh, they also never sent any terms from account inception, only a recon of current terms which don't correspond to the product you have - they're fucked, sorry but that's the only way to describe this.

    Why do you think 1st Credit sold it back to HBOS quick enough?

    As we always say, the devil is in the detail and the moment 1st Credit knew we had them by the balls they sold it back, shame cos now HBOS are left with that predicament

    As for the preference account, this is also 100% UE without seeing any paperwork, they always are as they are best described as a running credit at fixed rate which in essence means they'd need 3 sets of PT's at outset which was never the case so all these preference style accounts that were issued by barclays, cahoot, hbos and M&S are all UE - always.

    OMG, OMG, OMG.....pinch me I'm dreaming thats Brilliant News, we couldn't ask for better, this is the best news ever (apart from 1st Credits)your a Star Niddy, what else can we say.

    Was at hospital most of the day yesterday/night yesterday, didn't have much time to get on here.

    It's like we have been sent a Guardian Angel, to think that a few weeks ago we could have lost my Hubby to suicide as we thought we would lose our house because creeps like 1st Credit, Apex and other lowlife DCA telling us they could take our house, bankrupt us and such like and worst still, us totally believing them, until you came along Niddy.

    You are DCA's and Banks etc.. worst nightmare, they have met their match, however to all of us on AAD you are a dream come true, as we were living in a nightmare before you started to kick arse.

    You can described these agremnets in any form you like, if you say they are fucked then they are fucked....so in other words Apex 1st Credit and HBOS are full of carp.

    Never, ever would we have known about these errors, as said before your a minefield of Information, a deadly weapon
    I keep reading the post above I cant believe what I am reading you've not only made our day, it's like our Birthday, Christmas and Lottery (well we wish a lotery win) all at once, it's totally overwhelming.

    Hubby does not surface till late (due to Meds) can't wait to let him read your post Niddy.....
