Totally forgot about this one, for many years only ever received statements from Link Financial every 6 months or so and maybe few leters saying pay up or else.

Never paid since 2007 so would expect it to be SB however on checking a few of the statements they have allocated a £1 payment to this account in 2009 which would have been payment for the CCA that we applied for in 2009 is this allowed to be added to the account to restart SB clock, sure I have read somewhere that this is not allowed but not sure if was on AAD or when I was on CAG (many years ago now).

Now received a letter from Robinson Way today demanding payment, anybody any pointers on what we should do.

They obviously don't think its SB or do they and are just trying to bully us into paying.

Had few demanding letters and statements over the years...more up to date events below:

Mar 2014 - Received letter from Robinson Way demanding payment
April 2014 - Sent Statute Barred Letter
May 2014 - Received letter from Ro Way enclosing a copy of a letter I sent requesting copy of CCA in 2009 saying "As this acknowledged the account within last 6 years, your account is not Statute Barred.
May 2014 - Sent Refusal to Accept Statute Barred letter to Rob Way..
June 2014 - Received letter from Rob Way saying Notice of Home Visit.
June 2014 - Sent Letter Niddy complied telling basically and to the point PISS OFF.(See copy in post # 370)June 2014 - Another amazing result for Niddy and us. Rob Way has written saying due to Niddy's letter and comments they have removed the account from their files and returned it to Link who have been made aware that this is SB..

As you will see by the update above. Rob Way have sent Link packing all due to Niddy's amazing letter in my post #370.

Received a letter from Rob Way today, saying not to pay Doorstep Collector as their office is dealing with this acount.

Obviously Niddy's letter has crossed in the post, will wait and see what reaction I get once they get Niddy's letter.

They have put account on hold for 30 days.....they obviously are still not accepting this account should be SB.

Hi Folks

Well it seems as though another one is ganging up against us (all coming at once).

Today recieved letter from DLC statingthey have instructed Mercantile Data Burea(MDB) an associated company of dlc to manage this account and want me to contact them before they undertake any action with my account.

In the past they have had MDB write to us but Niddy & co on here found that thier licence was expired. On checking Companies House tonight it appears that they are now back up and running.

Niddy did deem this CCA as Unenforceable way back can't quite remeber why, also had a default notice that was not good. Also have PPI on this account.

According to our records this account should be SB this month BUT In September 2009 when we were on CAG they encouraged me to claim charges but thyey never paid out and FOS said wasn't under thier jurisdiction at that time.

Would applying for these charges in September 2009 stop this being SB this month.


Can someone please help....What do I do now...Send SB letter, Ignore or send another reply.

No you'll be fine - depends on the wording of the reclaim used but it'll be SB already now anyway - I'd just ignore these as best you can tbh.

I write reference to your letter dated XX May 2014 whereby you incorrectly, and quite mischievously try to claim that the above alleged account is not Statute Barred because a formal request was made under s.78 to determine liability back in 2009.

I must refer you to the Financial Conduct Authority CONC Guidelines and insist you read and familiarise yourself with them. Then familiarise yourself with the Limitation Act 1980 - there has been no contact for the prescribed limitation period as a CCA Request made under s.78 DOES NOT affect the limitation period, and thus this alleged account is indeed Statute Barred in line with the Limitations Act. Further refusal to accept this stance will result in an immediate and formal complaint being raised against you to the FCA, the ICO and the FOS.

I am extremely unwell and if anyone attends my property regards this matter I will call the Police and have them arrested and will conduct immediate legal proceedings against your company.

You have been warned and notified of your errors and incorrect assumptions, now I suggest you go and learn the rules before ever writing to me again.
