I have asked Three to provide proof the debt is mine, they have claimed they don't have to do this as Niddy said they'd probably do. The reason I ask is how I took the contract out, Carphone warehouse called me with the offer, took minimal details off me, posted me a phone from 3. I've never signed a contract, never clicked an online checkbox.
If I claim it's not mine how far will I get with this?

Signature is a proof of delivery at the door and looks nothing like my signature because it was done on an electronic device. They are not able to use this as my signature of contract because I've never seen a contract.
I was never read any terms and conditions on the phone.

I have the same with TalkTalk, all online except in this case I didn't even sign anything because rail mail couldn't deliver it and someone else signed for it on my behalf, not even my name or signature! I've never seen a contract, in this case I clicked a check box but I could be anyone, how would they prove it was me?
It has mainly come to light because I was thinking about the allowance of checkboxes on the internet, but these companies ask for such little personal information how do they distinguish between fraud or not?
