    This i know full well.

Partners aunty has 7 children and herself and hubby and they have a 4 bed house.

bit that annoys me at present is we seem to be paying a "premium" to be in a new build in comparison to other HA properties of similar size.

Partners brother and his fiancee and son live in a 2 bed ground floor flat and its almost 1.5times the floor space of ours and they are paying almost £25 a week less in rent. (or would be if they werent on benefits)

We just happen to live in an expensive town for property. Where as they live in a relatively cheap town only 13miles away

Also due to it being a new build it has left us with no end of problems like higher car insurance when we moved here £2.4k due to not being on RM's Postcode database thats resold to the insurance companies and comparison sites.

Then Meter issues for gas electric and lack of water bill until June

RA's arent the only problem for us atm Utils are about £1k too due to all the above fiasco.

I do think it will be settled with the courts especially seeing as we dislike living where we are due to it being a small flat and lots of Community issues.

We need a 2/3 bed house really with a garden for our now 3 yr old son (3 sat just gone) otherwise we are basically tripping over each other.

I just cant see how its fair that we can be pushed out of social housing bcos of a bellend thats paying a mortgage instead of us paying rent.
I've never had the luxury of social housing to fall back on. I was brought up to pay my own way in the world which meant when I ran out of money I had to sleep on a friend's sofa or floor, and I did many times in my youth

But I have definitely subsidized other people's social housing through my taxes I believe wholeheartedly in free (because HB pays the rent) housing for vulnerable people. But I'm less convinced that others should think it's their God given right to a free home if they are capable of working for a living to support themsleves.

Unless i'm working we cant afford otherwise is all i'm saying even with HB as our 2 bed entitlement is £107.31 per week which is only £465 a month.

There is very few private rents for 2 beds under £500 a month and they all seem to be no DSS too which would mean we would have to rely on Social housing.

I only wish to use social housing until i can afford to buy my own property due to the savings in rent versus to the market rate where we are.

If you don't like living where you are then maybe you could ask the HA for a transfer because they have a lot of property on their books Some HAs won't let you tansfer if you've got rent arrears, but some will and you can carry the arrears forward to your next place Check out their policy on transfers. Because if you don't like them and they don't like you (ASB issues) then it could be a Win Win situation all round

I had to look up the word "bellend" which you used in that post, and now I rather wish I hadn't

We asked about this in March coming upto the end of the starter tenancy as we made it quite clear we wanted to move.

I feel all the issues are to stop us moving into another SL house either with them or with another SL.

We've seen a load of properties we would have loved to move to with other HA's but have been unable to due to this current predicament.

Do you mean due to the rent arrears? Because if that's the only thing standing in your way then I'm going to make a radical suggestion which you will hate but at least give it some thought Why not accept McDonalds offer of £2.5k now instead of going to the ET in a year's time (which you may not win) and use that to clear the rent arrears and move to a better place for you, your partner and your little boy and still have some money left over

Sometimes things in life don't happen in the right order, but if that money would give you a fresh start than it's got to be worth considering this option

unfortunately i believe that the offer is no longer available and if it was i would still be pursuing against the HA as dont feel i should have to be paying now for their mistake.

If it had been my mistake then as said i would have had to pay for it in O/D fees at the time. And would have happily paid them so why is it not the same for the HA??

I agree with the amount of arrears since May 21st (when i was dismissed) but prior to that i feel that it was the HA's actions(or lack of) that caused the arrears to build up. They disagree however and Housing Ombudsman wont intervene due to court action so it seems it will only be settled in court.

Jen & FP you both seem to be saying that I should let it lie but of the show had been on the other foot would they have let a mistake by me lie? No as proved by the fact that they wouldn't negotiate any goodwill gesture on the RA's after their mess up.
Its not about making a point it's about not being walked over like trash because they think they can. It's as simple as that.

I think you are missing the point; yes things may have been handled incorrectly but you need to look at the bigger picture. It would not be an admission of guilt just being practical. If you could settle your finances with the HA then court action would finish and you could follow through with the ombudsman. That way you would hopefully be in a position to find a more suitable place, continue your battle and hopefully win.

I remember the story of a man who was accused of a crime he did not commit. He had a stark choice; he was remanded in one of Pakistans most notorious prisons (central Prison) and when he got his day in court, after suffering terrorist style torture, he could plead guilty and walk away having done time served or not guilty would earn a 7year stretch.

He chose not guilty and got 7 years.

                                Dilemmas dilemmas.

My point here is that I'm not going to say what to do cos you're a grown up. My point is to let you know that sometimes, just sometimes it's best to lose the fight but win the battle. Most people in your shoes, with a small child, would do anything to ensure their home was never compromised.

Your pride therefore must take second place.

Do not be an Erik Aude; instead be a man and stop this nonsense and protect your family. Think what this is doing to them....
