Reconstituted Agreements
I've been reading the excellent AAD guide to UE as a result of which I think I've got a better understanding of most aspects of UE, or so I thought at first! I'm sure I read somewhere that for Pre-April 2007 credit card accounts reconstituted agreements are NOT "valid,true copies and unacceptable"....

Odd Statute Barred argument by Claimants council...
Hello everyone!
Basic details are:
- CCA Loan taken out with Lloyds in 2004
- Defaulted Jan 2008
- Arranged to pay reduced amount
- Stopped ALL payments in June 2008 - no other contact/payments since.
- Account closed by Lloyds Oct 2008
- DCA via Solicitors brought

creditor not signed agreement can he charge interest and fees?
If an agreement is not signed by the creditor, so an unexecuted agreement. My question is; does the creditor have the legal right to charge late fees interest etc.
My own opinion is no! I appreciate he may be able to sign in the court room, if so that would not entitle him to backdate...

MBNA/Arrow Global - Blake Lapthorn
This is a sunmary of the chain of events on this matter. I've only found this forum today. I was on a previous forum but not making great headway.
Towards the end of 2012 I received a claim from Northampton Bulk Centre on behalf of Arrow Global relating apparently to a debt owed to MBNA....

Received Claim from BW legal
Hi, My partner has just received claim via CCBC from BW Legal saying the Claimant claims XXXX from defendant under a Current Accounts Agreement regulated by the Consumer Credit Act 1974.
As far as my partner can remember she has never held any such account. What can she ask BW to provide....

Consent Order to Amend Defence
I have asked the creditors solicitors to agree to me amending my defence by way of a consent order. They have replied saying they want to see my amended defence first before agreeing to allow me to amend. Sounds a bit cheeky to me. Black Horse Default Notice Q
Hi Everyone
I am currently battling BH over my car. I was just looking at the copy of the DN when I wondered if the dates and times are correct.
The DN is dated 17th Oct (Weds) and it says that I must pay the arrears before 6th Nov (Tues). The DN was sent by 2nd class post....Last edited by mrs bucket; 26 November 2012, 20:22.
