        Hi Natty

        Sorry I haven't had chance to respond yet, been stupidly busy at work, but I know you have until the 12th so there's plenty of time.

        If you want to respond I'd leave it until next week and enjoy your weekend - they're not going anywhere

        Will be interesting to see how P2P react. I suspect that your account will get sold, and if it doesn't their response will probably to reject your claims, but you never know!

        Still no update from P2P. They did say I would get a response within 8 weeks. All the payment chasers have now stopped.

        I have to say a big thank you to you for sticking with me and guiding me. I really do appreciate the time and effort you have given me, whilst dealing with your own issues.

        It is now June, I smile when I look at my first posts in January when I was extremely stressed thinking DCA would turn up at my parents home.

        Yes it is June and I am still alive and breathing.

        I will await further instructions fom you.

                Hi Natty

                I guess its time you got a reply across to the FOS. I'm assuming that you still are not in agreement with their findings?

                If that is the case then something like this:

                Dear FOS Person

                Thank you for your email and letter of xx/xx/xxxx with regard to your findings of my complaint against Lendingstream.

                I appreciate the time you have made in looking at my compaint, but unfortunately I cannot agree with your conclusion. This is primarily because many of the points of my complaint (as made in my letter to Lendingstream dated xx/xx/xxxx), have not been addressed. I appreciate that some of these points are legislative, and therefore may fall outside of your remit, however it is still reasonable to expect Lendingstream to address those points, and they have not. The simple fact that Lendingstream have already written off one of the accounts due to failure against their lending criteria I feel is precedent enough to support my point of view.

                My hope is that this can be resolved, however to move forward Lendingstream need to address all the points of my complaint (not just to respond to a select few), and until such time that Lendingstream address all of the points of my complaint then I will consider the matter to be deadlocked.

                        Hi SnV,

                        I hope all is well with you. I have received the following response from the FOS and have to the 1 July to respond:


                        Dear Natty,

                        Thank you for your email and letting me know your thoughts on my opinion.

                        I appreciate your strength of feeling and I know you raised a number of points in your initial complaint letter of 5 January 2015. I relayed your concerns to Lending Stream as part of my investigation to respond to what you said. While I accept you made four specific points in your letter (that of your creditworthiness, the true cost of borrowing for the loan, pre-contractual information and loan suitability), I summarised a response to these in my opinion letter under ‘the other points you raised as part of your complaint’.

                        I accept as well that Lending Stream wrote off one of your loans. However, I feel this is a separate issue as to the affordability of the other ones and whether you should be reasonably held responsible for them.

                        What you touched on yourself, we act as an informal dispute resolution service to the courts and make a determination on what we consider to be fair and reasonable. It’s because of this I’m afraid that I can’t conclude the loans were unaffordable at the time you applied for them.

                        As before, if you’d like I can speak with Lending Stream to recalculate your accounts to have the interest and charges removed from when you first experienced financial difficulties (January 2015).

                        If, however, you still remain unhappy you can ask an ombudsman to review your complaint for a final decision. A final decision is a review of your complaint carried out by a senior colleague.

                        I’m afraid the case cannot be left as being deadlocked.

                        Please let me know what you would like to do. If I don’t hear from you by 1 July 2015, I will assume you no longer wish to pursue your complaint within our service and I’ll close my file.

                            However, FOS are known to be spineless.

                            As for the case "not being left deadlocked" FOS cannot force you to accept any decision they make.

                              Hi Natty - yes and you've got lots of time to submit a response (1st July)

                              I know its difficult when things are stressing you out (and obviously all the stuff going on at home) but please try to keep in mind too that we do this on our own time, and we're also helping other people whose deadlines are a little closer, plus we have our own stuff to deal with!

                              Thats not an admonishment, you just don't need to rush things at the moment, in fact the longer you drag things out the better as it gives you breathing space.

                              There is certainly nothing wrong with dragging things out a little further now you have come this far but ultimately, its more than likely that an Ombudsman will support the Adjudictor.

                              When the above happens, the real question is what do YOU want from this? What would be a result for you? And I mean all the results, not just the ideal one where LS write off all your loans (which they're also unlikely to having an FOS decision backing them).

                              Once the FOS complaint is done and dusted, we're then back to dealing with LS and whatever debt collection agency that they assign the account to so whats your appetite for dealing with that?

                              I know I've asked the question before, but its worth asking again as peoples views change!
