Agreed you will not find a forum with the same philosophy as AAD. I posted on a certain green topped consumer forum and was met with daily abuse by PM just for helping people and offering advice on how to handle companies that operated in ways that would be considered immoral or even unlawful (suggesting that they can have you arrested at your desk for not paying back a loan for example). In 3 years of posting here I've not experienced that once.

A particular consumer forum that has google ads for payday loan companies on the very section that is meant to help people who have problems with payday loans

From my own area of 'specialty' I've also seen advice on other forums with regard to PDL companies that is just based on 'heard it down the pub' facts (for example the one that they are not allowed to charge more than 1 months interest. This one actually came from a couple of sources - the first was that this was a contractual statement written into Wongas early credit agreements that they wouldn't do this and second that it was a recommendation from certain trade bodies that this be established as a 'good practice') but this is not based on contractual law and its stupid to argue such unless it is stated in the credit agreement which leads me onto.......

I have also seen people stating that there is no point sending a CCA request off to payday loan companies. While this may be accurate from a s77/78 standpoint and trying to argue enforceability, it is forgotten there are still many benefits in getting a copy of the agreement that may have been entered into.

If a payday loan company has their house in order and is able to provide a copy of an agreement (you'd be amazed the number that cannot and once they cannot its game over), then there are still plenty of things of benefit to understand:

• Is it a rolling agreement, or fixed term - important!
• Do the terms contain information about interest and charges (very frequently payday lenders add charges they are not contractually allowed to do)
• Is there anything in the contract with regards to continuous payment authority, if they do not cancel a CPA when requested to do so for example
• Do the terms allow provision for contractual interest (not statutory interest) - important to consider if things were ever to get to court etc etc.

A common saying on AAD is that each case balances on its own merits - this couldn't be more true and why this forum is very different, as although there are standard templates for responses to creditors, they are usually advised to be used in the context of each individuals circumstances.

My own strategy with payday loan companies is simple - I give them opportunity and enough rope to hang themselves through demonstration of unreasonable behavior and then adapt the responses accordingly.

For example....

While a high APR is not necessarily enough to argue this point I am having some success at the moment by pushing back on PDL companies using the 2006 amendment (section 140A) of CCA1974 using Unfair Relationship Provisions (which replaced the 'extortionate credit bargain' of the original act) because of their subsequent actions once someone has defaulted (for example refusal to consider payment proposals when demonstrated with the common financial statement and continual breach of OFT debt collection guidance).

While this is not in the power of an individual consumer to action I am testing in letters of complaint to PDL companies that not only a threat to the OFT is made, but to state that the OFT will be asked to examine the possibility of bringing action under section 8 of the Enterprise Act 2002 as the PDL company has t&c's in its agreements that harm the collective interest of all its customers.

With the entire PDL 'industry' under close examination at the moment this statement in the couple of times I have used it is appearing to be effective.

As I mentioned above though - each case is different, each person is different, and as Cecilia has discovered, even creditors deal with things differently, and sometimes the same creditor will react differently to two 'debtors' even though the circumstances are almost identical.

We have MSE's best mod & CAG's best mod as well as a few LB Senior Posters on AAD. It's not about cock size for us, it's about having the people here that are experienced and able to help you guys, those that need it the most. Too many others are more concerned about the size of competition they forget what they were created for - we don't lose sight of this, we know that we were created to help those that need it, and that stands. My input only dictates that we will never sell out our users or have advertising banners on our forum.

I am paying other PDL's PaydayUK,Swiftsterling, Mr Lender.

Only because those are the 'reasonable' ones who have agreed (after a 'little' arm bending) to your payment proposal.

We'll deal with Speedloan Pounds to Pocket/Quick Quid and the Money Shop differently. Speedloan simply because they haven't been helpful (though they have their own troubles hahahaha), P2P because they have behaved like @holes and quoted American legislation at you with their threats (and throw QQ in there with them), and Money Shop simply because of the outrageous amounts of interest you've paid.

I could write a book on this subject with regard to payday loans. If you look through the forum, and my comments on how this 'industry' works you will soon get an understanding of how its allowed to continue. However if the current situation continues a large proportion of the country (who are starting to fall for the slick marketing and seeing PDL companies as 'mainstream') will be unable to borrow from high street lenders (as PDL's on CRA files are seen as an indication of financial stress, whether they were repaid impeccably or not).

This will allow the PDL companies to step up and start offering other products to a market they have effectively created themselves. I constantly warn it will not be long before you see companies like Wonga offering mortgages..........



Good news is Cecilia hasn't paid a penny since finding AAD

Trouble with The Money Shop, and the difficulty it presents Cecilia, my experience of them is that if the cheque cashing service has been used, chances are there will have been no CCA agreement signed, so challenging agreements, lack of affordability assessments, providing pre-contract information etc is much more difficult.

This is one of the reasons I ask people to calculate how much interest has already been paid to a creditor. Not only does it give a timely wake up call but it usually gives huge leverage on another angle, which is whether the creditor falls foul of the Unfair Relationship Provisions of the CCA.

I don't think theres any doubt that this could be used against The Money Shop in Cecilias case, however I've not worried about them much in the context of Cecilas overall 'PDL portfolio' as they have been the least aggressive which suits the goal of getting the account to being stature barred.

I will look through my mountain of paperwork to see if there is any CCA agreement for the cheque cashing. I know they made me sign something initially, and whenever they increased the interest on the cheques I had to sign something else. They also regularly asked for proof of payslips, and bank statements.

I am the same with my forum... I KNOW there are bigger ones, ones with flashy banners, celebrity members and amazing competitions.. I'm about being there for REAL parents to chat about REAL parenting issues since 2001.. not promoting corporations to exploit parents and con them into funding items they 'must have' but really.. don't need.
