    Ok so you MUST treat below as a formal 'Letter Before Action' and needs the LBA response I mentioned earlier.

    Send the same letter to them as you did Motormile Finance, make sure you do that asap, and make sure you send recorded delivery and keep the receipt with the tracking number.

    Thats garbage. Send off the letter in the post if they haven't already and converse that way if they insist on asking for your d.o.b

    Hi Cecilia

    Ok so 'commence recovery action' is such a broad term it could just mean they will send you more threatening letters, but you want to nip this in the bud.

    Amend the following template and send it to Motormile Finance asap:

    See how they respond to that. Their letter isn't really a formal LBA (they should have given you a deadline to respond, for example, for it to be a formal LBA) but as they have said they WILL instruct solicitors lets treat it as such

    ps remove the following paragraph from the letter too as it has no bearing on your situation:

    You will no doubt be aware that in addition to the PD-PAC requirements there is an additional responsibility to supply documents which is imposed by the Consumer Credit Act 1974 (“CCA 1974”). A request was made under s.77 / s.78 / s.79 on the xx/xx/xxxx and this has not been complied with. The agreement is therefore rendered unenforceable whilst that failure to comply remains outstanding. To issue proceedings in such circumstances would be premature and would be met by an application by me to strike out the claim as having no prospect of success.

    We have been attempting to contact you and secure a solution to repay the above account for some time and have been unsuccessful so far.

    Hi Cecilia

    Long time no see - great to know you've got two PDL accounts finishing next month!



    Motormile/Motormouth are known for buying 'uncollectable' PDL accounts, and can be aggresive, but AAD has helped people in the past see them off. The letter you mention on post #490, is that the first correspondence you've received? Have you had any notice of assignment?

    If not then I'd ignore for now, and when they get persistent, you can send a 'prove it' letter to start with.
