    I would object!
    Tell them what you can afford to pay! Don't listen to what they expect. No more charges and I will pay you X per month. If you add charges I will await a decision from the court. No income & expenditure unless ordered by the court! End of.

      I think I will try and hold out and see, give it a lot a thought, I would prefer to be rid sooner rather than later!

        Oh I also got default from payday express about a week ago, the letter asked to pay within 14 days, though I'm on a plan with them which I have in writing and has been paid on time, guess my credit history fecked now, but sure I knew that already!
        No buying any house for me for 6 yrs.

          If you have been making payments and they are up to date, they have no moral ( sic ) right to send you a Default. I would check to see if they have Registered it, I guess they won't have.

          Write them a letter along the lines of....' We have an agreement in place, I have been paying all I can to settle, I have kept my side of the bargain etc and ask that they withdraw the Default Notice.
          One point, it will only be on your File ( possibly ) if it's a proper Default Notice not just a so-called default.

            Payday express do indeed issue defaults and my understanding from Paul is that as it is a fixed term loan with a single repayment there is no need to issue a DN just a notice of intent to file one.

                Regarding Payday Express and your recent post and the one in May where they added charges after making an arrangement with you.
                I would write and tell them that you are ceasing payments as they have clearly lied to you and have taken the opportunity to make extra, punitive charges even though you have proven to them your financial situation.

                Tell them that you will be expecting a refund of all charges and interest since the day the arrangement was made, the withdrawal of the Default and amendment to your Credit Files if necc and an APOLOGY. Failure to do any of this in 10 days WILL result in a Formal Complaint and claim for Compensation for the distress they have knowingly caused.

                Really, Tinks you are doing well,but have more cards in your hands than you think and they are all Aces. I'll watch this thread.

                  I agree that there should be no charges/interest applied after an agreement has been entered into, but why do you think the default notice should be withdrawn, or for them not to make entries with the credit reference agencies?

                  At best there will be an arrangement to pay marker with the CRA's. Unfortunately they are perfectly entitled to report the conduct of the account to the CRA's. As Tinkers has breached the original agreement they are entitled to report this - payment arrangement or not.

                  Its also important to understand the differences between a default notice issued under the CCA as is not the same as marking a default with CRA's.

                    thanks for advise guys, before the default notice arrived i asked about the extra charges and forwarded them an email in which they had clearly stated my balance and asked why charges were added, which i thought was unfair, and that a patment had been made every month on time since defaulting. they responded with the proper balalnce left, so i guess thats sorted. i havent checked on CRA as yet but i know its a likely hood and i accept that.

                        Yes ken, feeling a lot less stressed and happy!
                        I'm going to plod along and pay off in agreed time and the
                        Light will then be closer by!
                        However when payday uk done deal they wud only agree to a plan for four months
                        And then discuss, so I can maybe dwindle this one without affecting the rest & I also cut down my sky package as
                        The year was up, they reduced by 50% so that's another saving, I prob u think should have cancelled the lot, but when
                        Spending so much time indoors, I def need broadband! I'm doing very well on tightening the belt !
                        Hopefully pduk will be accommodating, but hey I won't mind a good olde bitch fight with them!

                                thanks i must rem that! ive received the best support on here and would never got have through all this without your help, there are some wonderful people on here and it feels like a lovely community to be part off.
                                i now have the strength and confidence to deal with things and am a lot less anxious than i was a few months back, it has helped having people to talk to and share my experiences, i just wish id found this site sooner, would have saved a LOT of money! anyway, no point in looking back!
