    Sorry I'm quite a panicker!
    I thinks wages ok in the other account, I lifted some money, paid some bills ect, no pub for me, been sick all week lol
    Don't usually have luxury of going to pub! Once in blue moon lol
    I double checked the wonga site and it's only the ulster bank details showing, only so fingers crossed.
    Do you think I should email them the letter tomoro before default on Sunday?

      Payday uk have come back and said £50 for 4 months then reviewed, pls confirm debit card

      Yea, I will write back stating to read my letter again and will stand firm!

      Standing order please and I propose 10 month plan only or will refer account on, think I will wait few days before replying
      Not even an email from express yet and sending wonga letter tonight eeekkk

        Got standing order details from payday uk, tho I've emailed them back to confirm in writing, if they accept my 10 month proposal.
        I declined their first proposal to me, which was a four month plan, asking them to refer back to my original letter.

        No response at all from payday express, will continue to email every day for my records, does anyone have any lines I could quote to them for not responding!?!?! Very frustrating. 'In breach of any guidelines?' Thanks

        No proper response back from wonga either, but have emailed every address I have found for them.
        Will post letters to wonga and pay express when I'm back on my feet again and out of the house, being ill sucks!

        Will update accordingly

          Sorry I don't have time to read them but here are the OFT guidelines on debt collection and the CFA code of conduct (might be a bit out of date) which they are a member of

            Ok well it sounds you're off to a good start. Remember, you remain in control and only offer what you can afford. They should have regard for your common financial statement (CFS), and if they continue to ignore this, and continue to demand more, then tbh you could tell them to go find a fork.

              Unfortunately we are unable to continue with your repayment plan application.

              Our accepted criteria for a repayment plan is proof of one of the following:

              • Significant Loss of income
              • Unexpected change in personal circumstance, e.g. Long term sickness
              • Severe Disability or illness (including close family members)
              • Terminal illness or Mental illness (including close family members)
              • Deceased (including close family members)
              • Redundancy or Reduced hours (contractual hours reduced by company)
              Our opening times are: Monday to Friday: 9am – 5.30pm

                Was your payment proposal supported by a income/expenditure sheet in the common financial statement (CFS) formal?

                If so then PDE are in breach of OFT guidelines specifically below.

                It means now that according to OFT guidelines your account is now 'deadlocked'. This puts you in a stronger position.

                I'll be back later to give you a few options on what you can do next. No need to worry, their email is all part of the 'game'.


                Deceptive and/or unfair methods
                • 3.8 Dealings with debtors and others are not to be deceitful and/or unfair.
                • 3.9 Examples of unfair or improper practices are as follows:

                • refusing to engage, appropriately or at all, with a third party representative, such as a debt adviser at a free advice centre or a debt management business, or with a debtor developing his own repayment plan, unless there is an objectively justifiable reason for doing so

                • under appropriate circumstances, failing to refer on to the creditor reasonable offers to pay by instalments


                Deadlocked debt
                • A.4 Where we refer to discussions about debt repayment being 'deadlocked' we mean that a debtor (or the debtor's representative) has acknowledged (the debtor's) liability for a debt and has proposed a repayment programme – but the proposed repayment programme is not acceptable to the debt recovery business (or the creditor if not pursuing recovery of repayment of the debt on its own behalf).
                • A.5 While businesses should not be required to accept any offer, we would expect them to give serious consideration to accepting any reasonable offer. Under circumstances in which a business rejects a repayment offer because it considers it to be unacceptable, we do not consider it appropriate for the business to engage in any conduct intended to, and/or likely to, have the effect of intimidating the debtor into increasing his repayment offer.
                • We would have particular concerns under circumstances in which a debt recovery business rejects a debtor's repayment offer as being unacceptable – but cannot subsequently demonstrate to our satisfaction why the offer was considered to be unreasonable (for example, if assessed against the Common Financial Statement or equivalent).

                  No, I didn't include an income and expen, just a letter stating in difficult paying and offered a 10 month plan at £45 per month.
                  After sending the same email and getting no response that it what I finally got back from them.
                  I've now had an email, stating an issue of default.
                  I'm unsure how to respond. I will not be phoning, I just keep repeating all communication in email only!

                  Payday uk emailed back and once I gave them a rough I & E they have accepted a token payment of £5' and £52 per month for four months then again to be reviewed. I'm happy enough with this.

                  Wonga looking me to fill in income and expen as well but having trouble getting the link online and I'm back and fourth with emails, I'm hoping to god that no emblazoned envelope pops through the doors if I am having discussions with them.

                    Btw, attached they send doc of info re arrears, which states helping set up plans and getting in touch!

                      Wonga have agreed to payment plan, just like i asked...emailed back to ask for their bank details, waiting on reply! Result, I hope! Got text saying they were very busy with emails and would reply back soon..
                      Just praying no emblazoned letters thru door, but hopefully not ��

                      Payday express ignoring but will just keep emailing the same letter - not going to stress since they have no tel numbers for me, changed em online, good advise from salt n vinegar whilst browsing this forum! Maybe they are busy after all this OFT stuff

                      So wish I'd stumbled across this site months ago, would have saved a fortune, son I will be debt free!

                              Even if things dont quite go right at the start the journey and battle is started.

                              There will am sure be blips but if our own situation is anything to go by life is unrecognisable to what it was 8 months ago.

                                yea i know, payday express states i do not fall under their 'catagory' for repayments plans!!!

                                i need help writing a reply to them!!!! or i will just let it go to a dca if necessary.

                                i printed off the 'arrears info they attached to their default, i wrote a few lines
                                in a letter, stating that i have contacted them and they are unwilling to help in difficulty, i also wrote that surely this is not along the guidelines of the OFT, they apparently only help if loss of job, hours ect , somewhere in previous posts i copied what they sent...

                                i havent actually posted that document off to them yet, ill await and see what saln n vinegar has to say!
