    Hope you had a more relaxing weekend now everything is in hand.

    I'm guessing that you've heard no more from PDE. I expect they'll now do one of two things:

    1) Write off the debt and you'll never hear from them again apart from the odd email
    2) Sell the account to an external DCA (and we can deal with that if it happens)
    3) Accept your payment proposal

      Yip sant n vinegar, a lot less stressed!made token payment to wonga as I wanted plan to start April and they give me details same day as they wanted plan to start, which was obv impossible, anyway I just keep emailing them saying ill make full monthly payment in April so hopefully it will be fine.
      They seem quite unprofessional, one hand doesn't know what other is doing with conflicting emails!
      Just kinda need to get new plan in writing, they agreed first time so fingers crossed, had no option but to do this as waited soo long in stand order details, grrr

      Anyway RESULT, after me continually sticking to my guns, payday express finally agreed to my payment plan, have token paid them too, starting plan in April, I'm starting to see the light!

      Feeling like I'm in control now

        Yes this is deliberate and I'll explain why. You may now get an email from Wonga stating that you did not keep to your payment plan because you did not make a payment as agreed.

        Now the reason that you didn't make a payment is because Wonga did not provide their bank details until the day you needed to make the first payment but this doesn't matter to them, even though its their fault - you breached the agreement.

        Because you breached the agreement this gives Wonga an excuse to try to take a payment by CPA, so should you have given them your bank/card details they now would have wiped you out.

        So hopefully they won't try this silly game with you, but just to give you a heads up and not rest on your laurels.

        Yes quite normal for Wonga - remember they are just not geared up for collections activity. I understand that Wonga are trialing some debt collection agencies but haven't come across anyone yet who has had contact from them. Will be interesting to see how these 'debts' are approached.

            nothing from wonga for about two weeks.
            email this morning, obv they didnt read letter and asking proof off difficuluty, i said read the letter, spirally payday loans!
            they asked for payslips and proof of debt ect - are they entitled to this or what???
            this one dragging on a bit! tho im def nort really stressing, told them to re read letter and if they dont accept plan i will hand over to a debt mana company???

            any thoughts anyone????

              Only a court can demand this Tinks.

              There are occasions when I can see when it helps your case. But other times its just used as a tool to try and extract more from you because you actually ate something this week.

              If you have a complaint in think I would keep gently reminding them of it. If its not stressing you then keep to what your are doing.

              Am sure SnV be along sometime to guide you better.

                i thought that, i emailed them bak and said i wouldnt be sending any personal info as they werent entitled to it! i bluffed it! lol

                    Hi Tinkers

                    I'm a little confused - didn't Wonga agree to your payment plan and didn't they give you their bank details only a short time ago?

                    So what are they up to now?!

                    In short:

                    1) No you don't have to provide them with payslips - absolutely not never in a month of Sundays give these to ANY creditor ever!

                    2) No you don't have to provide 'proof' of the reasons of your financial difficulty. Wonga apparently make an 'affordability assessment'. Its their problem its complete bollox.

                    3) Wonga (according to their t&c's and their website) should freeze interest after 3 days of arrears so you shouldn't have to worry about this. If this is not the case then you have them by the short and curlies (but you do already as they are not dealing with your financial difficulty in a timely, efficient, or empathetic manner)

                    4) You can make a complaint to the OFT and tell Wonga you are doing this. They'll soon back down.

                    Ultimately they cannot get blood out of a stone. They can either accept your payment plan or they can go forth and multiply

                      If you have an email from Wonga agreeing to your payment proposal then thats your trump card.

                      If so then I would just go back to them stating that sufficient information has already been provided to them, that you have an agreed payment arrangement in place as per their email of xx/xx/xxxx, and that you consider their continuous emails to be an intent to pressure you and is harassment, and if they continue to harass you when a payment arrangement is in place you will report them to the OFT.

                      Words to that effect

                      Or you could tell them to FO and they're not getting a penny!

                        Salt n vin, sorry I ramble and confuse at times lol

                        A payment plan was originally set up, I failed because I hadn't received their bank details in time, even tho I repeatedly asked for them. Then they said I failed and withdrawn the plan. I told them why I failed, no bank details

                        I made a token payment and emailed them and let them know and asked again and again for plan to be reset but heard basically nothing.

                        . After resending the same email about 20 times, I got one back asking for payslips lists of creditors ect.
                        I replied saying they wouldn't be getting any of that and if plan wasn't set again then I would have to think about going to the OFT if they didn't accept plan, I'm still waiting on reply.

                        Am hoping they do so I can start paying off and getting rid of those wanks, excuse my language, for good!

                          Dear Wonga

                          I am disappointed that I have to resort to submitting a formal complaint regards your conduct in relation to this account.

                          On xx/xx/2013 I informed you that, due to numerous circumstances, I was in significant financial difficulty, and I offered a payment arrangement to you that I was realistically able to afford.

                          You ignored this email, and the loan defaulted on xx/xx/2013

                          I continued to email you informing you of my difficulties, and sent xx emails between xx/xx/2013 and xx/xx/2013, all of which you continued to ignore, but instead proceeded to send me standard template threatening emails which did nothing to address the points in my emails or enter a meaningful dialogue in resolving the financial situation.

                          On xx/xx/2013, someone within your organization actually read one of my numerous emails and responded by email agreeing to my payment proposal. I attach this email for your attention.

                          I thought this agreement by your organization was the end of the matter, and on xx/xx/2013 requested by email that you provide your bank details so that I could set up a standing order for payments to commence on xx/xx/2013.

                          However you ignored my email requesting this information.

                          I sent you a further xx emails requesting this information, emails that you continued to ignore until xx/xx/2013, which meant by this time, I had missed the date of the first payment.

                          As soon as I received your bank details I make a first payment of £xx.xx on xx/xx/2013

                          However you now state that the payment arrangement is now cancelled as I have not made a payment on the agreed date, despite the fact that it was due to your lethargy by not providing your bank details to me that was a direct cause of this breach in the first place.

                          I can only reason that your inaction in providing me your bank details was a deliberate act with the intent to cause me to breach an agreement that you made, as you have no real intent make this agreement in the first place.

                          I do not understand why your company has decided to act in this manner. I have tried to resolve this responsibly and in entirely good faith, however I have been made with unreasonable, obstructive and threatening behaviour. I hope that this is just an error on your part, but the consistent pattern of your behaviour gives me no other choice but to believe otherwise.

                          I am bemused that your company continues to operate in this manner considering the amount of negative press and attention that your company are currently receiving and that your conduct will be of great interest to the OFT considering the investigations they are undertaking into the payday loan industry.

                          Please be aware that I have taken professional guidance on your companies response and believe that your conduct in dealing with this matter places you in direct breach of OFT guidelines on debt collection.

                          Consequently please be advised that unless we can conclude this matter amicably I will be making a formal complaint to the OFT providing them with all the email evidence demonstrating your unreasonable and obstructive behaviour.

                          My expectation is that you will honour the arrangement that was agreed by you on xx/xx/2013 and that you provide confirmation of this by email within the next 10 working days.

                          Upon receipt of your confirmation I will be pleased to make the next payment of £xx on xx/xx/xxxx as per the agreed arrangement.

                          I trust that this will be the end of this matter and we can resolve this amicably without the need for any further action or correspondence.

                          Please note this will be my final correspondence on this matter. I have made a considerable and significant effort in an attempt to resolve this with you which you have not reciprocated .

                          Please be advised that my other creditors have agreed to my payment proposal and have already received payments.                             I have attempted to resolve this on multiple occasions. You have done nothing to assist me except be obstructive tossers.

                                Hey salt n vinegar

                                Another super letter, I amended and tweaked and emailed to every address I hold for wonga, so lets see what happens

                                I have plenty of email evidence if it comes to formally making a complain for OFT, but hope it doesn't come to that!
