    Well done with Wonga and Payday UK. The pressure being put on them from the OFT seems to be working in your favour at the moment. I think we can use this in your next letter.

    I'll promise to get back to you later today with a suitable response. Just to confirm:

    1) You've made a payment proposal which they have rejected

    2) You haven't provided an income/expenditure sheet

      If you're determined to continue with your payment offer then I'd suggest sending them something like this:

      Account Number: xxxxxxxx

      Dear PaydayExpress

      With regards to the above account I have made numerous, repeated attempts to inform you that I am in severe financial difficulty, and have made a reasonable payment proposal to you that is the maximum I can in the hope that an amicable settlement of this matter can be reached.

      I was disappointed to note, therefore, that you have refused to accept my payment proposal of £xx.xx/month on the basis that I do not meet your 'accepted criteria'.

      Be advised that I have taken advice on my financial situation with recommended debt charities and with their assistance I have made pro-rata offers to all of my creditors.

      Please note that ALL of my other creditors have accepted the payment proposals made to them and that you are the only creditor refusing to do so.

      I will repeat my earlier assertion - the payment offer of £xx.xx is the maximum amount I can afford to pay you.

      Please be advised that I am fully aware of the OFT guidelines on irresponsible lending and debt collection, and I find it disappointing to note that you are breach of these guidelines by refusing to accept my reasonable offer when it is clear that this is the maximum I can afford.

      Your demands that I increase my offer, when it is clear that I cannot, also places you in breach of OFT guidelines.

      Your conduct in this matter also places you in breach of the lending code of conduct of the Credit Finance Association of which you purport to be a member.

      I am disappointed to note your conduct, especially in light of the very recent OFT report into the conduct of payday loan companies. If your intention is to continue in breach of both OFT guidelines, and the industry body of which you are a member, then please be advised that I will make a formal complaint to them, and other appropriate regulatory bodies including but not limited to the Ministry Of Justice and the Financial Ombudsman.

      Please note that further refusal of my offer of payment will be noted, and be kept as evidence.

      I hope that such action is not necessary and my preference would be to resolve this situation amicably, therefore I will again extend my payment proposal to you of a payment of £xx.xx/month to clear the full outstanding balance of £xxx.xx

      I consequently hope that you will agree to my payment proposal and with your acceptance please provide your bank details to enable me to set up a standing order and make the first monthly payment.

        Just wanted to add - well done on holding your ground on this. Under NO circumstances give them details of your new debit card - EVER!



        They will try all sorts of tricks to get this information - need it to set up a payment plan, need it for first payment blah blah.

        Wonga have been known to tell people they are due a refund but can only pay it if latest debit card details are provided........... I kid you not

        (and by the way - Wonga - if you are reading - I actually have these emails and can prove what I say)

        You're doing all the right things, and preventing abuse of continuous payment authority by not giving them your new card details, guard these with your life!

        BTW - I hope this advice isn't necessary but I know how tempting it can be............

        Don't apply for any more payday loans ever. I'm not saying this from a moral standpoint but from a financial one. You would be shocked at how many of these companies are linked, or share data with one another.

        I have dealt with too many people who have done all the right things, only to apply for another payday loan with a different company to have their details passed to one they have defaulted with. You can guess the rest............

          Hey guys

          S&V that letter was great, I've it mailed off and await their reply! Emailed it this afternoon, only getting replying now, will play the waiting game now. Oh I've learned, when I think of the money I've practically threw down drain, this guys have got fortunes off me, I even cut my credit cards up! They've all had loans back and more
          I don't have an overdraft for the old acct for them to try, but can u quote me a line re the CPA? I'll write just in case, I'm safe guarding everything! When ur less snowed under, you've done loads for me
          This site is wonderful, you are all great guys, when I'm finding things a bit easier soon I will def be donating ☺
          I seriously don't know what I'd a done with stumbling across this site, CAG seems a horrible group ��

              My outlook is brighter with the support here, and being able to talk about it... Not something I've been keen to bring up with friends, embarrassed
              Has made such a difference, the advice is Excellent, totally agree with membership fee!
              There are lot of people giving up their own time to help others!

                It is hard to talk to friends about it all...Others know all thr gory details and if you are sad enough to want to trawl all my posts you may be able to work it all out.
                There have been one or two misunderstandings where people hadn't kept up with my rapidly changing life but never any judgement. I mean god I would have judged myself once upon a time. I have now told a few close friends and obviously my OH who is incredibly supportive and says he will take me away for my recent B/day

                  I have also cancelled the CA payments with my bank, in accordance with the Payment Services Regulations 2009, regulation 55, as governed by the FSA.

                  Any further attempts by you to take a payment using CPA will now be classed as an ‘unauthorised transaction’.

                    Thanks salt n vinegar for that

                    Been busy all wkend and not been On, still haven't got wongas bank details, nitemare! They think plan set for 13th, i keep saying no as don't have their details but obv they won't be able to collect anything!
                    Will get those cpa's off tomoro

                    Have mailed pdexpress that letter Friday, they send me overdue email today, I send letter again, will keep on doing so! Arrgh

                          I keep torturing them with same emails , letters every day. Today I finally got bank details, still thrashing out my plan but ill be still to what I said!

                          This forum has made me smile again after constant worrying and never ending cycle for over two years, ��

                            Good stuff - Wonga really don't like doing this - remember their goal is to get YOUR bank and debit card details.

                            At the same time, they refuse to give you theirs, and so refuse to be co-operative and effectively refuse a payment, means that you have them over a barrel as it shows them to be unreasonable.

                            As you've not posted I guess you've not heard back from Payday Express. Wonder why that is?

                              Payday uk sorted

                              Back and forth with wonga, as I say got bank details but they were expecting payment before hand, I just emailed flat out and said token payment this mOnth, and full proposal next, seem very unprofessional as keep getting conflicting emails! Arghhhh frustrating but getting there I think.

                              Still battling a bit with express but hey, I feel like I've the strength to do that now thanks to u guys!

                              Salt n vinegar, u have been an amazing source of Info n soon I wish to donate to ur paypal to say thanks, have few beer on me, as ur letters have been super! 
