    Hi all,

I have received reply from MKDP.

I definitely will file this away very safe

Thank you Niddy and Plan B. I know they won't stop chasing but at least they cannot do anything legally.

Highlight those two paragraphs in yellow and the last paragraph on Page 1, and attach the whole letter to Niddy's letter (forget the Barclays' letter for now).

Add a small paragraph into Niddy's letter after the one ending in "will not work" which says something like "Your client MKDP is also fully aware that this debt is unenforceable which they confirmed in writing to me on 20th May 2014 (see attached)".

Lucky you to have that letter even if you never posted it on the forum. Something tells me you won't be hearing from Keynes again after this.

    Here's the one from MKDP.
If Keynes are silly enough to issue a court summons then that letter from Barclays and that letter from MKDP could be the two exhibits you'd attach to your application for a strike-out of the proceedings before they even get to first base

Your letter is saying that you have confirmation from Barclays that no agreement exists, but it's possible that Keynes won't know that unless they've been given a copy by MKDP (which I doubt) , so spell it out for them.

Thanks PlanB! Will attach a copy of the unenforceable letter from MKDP with Niddy's template to Keynes. Sending it on Tuesday via RD.

    Thanks Niddy!

I will use the above template.
And if they do ...."any attempt made by you to harass, bully or intimidate", I know where to get help

    Dear Sirs,

    Ref: xxxxxxxx

I write with reference to your recent letter dated xx/xx/2015 and note the content within.

I'd like to draw your attention to the fact that I've already got confirmation from the original creditor, Barclays, that there is no such original agreement and thus any attempt made by you to harass, bully or intimidate me will not work.

As you are aware I would be acting as a litigant in person and you will also be aware, it would be my intention to defend any such claim should one be issued.

I therefore suggest that you close this account effective immediately.

    Yours Faithfully

I'll ask someone to pop in before Tuesday to agree whether or not you should send a fresh CCA request or just the LBA response template letter. In real life I would suggest you send them a copy of that Barclaycard "we cannot enforce" letter but Keynes don't live in the real world. However there may be a way of combining that info with the LBA response letter.

Have a lovely Easter and try not to worry

Thanks PlanB! I tried to include the letter from previous post #592 but when I click reply with quote, the letter doesn't show on new posts
And I am not good with computers.

    Ok! Will wait for advice.

Thank you! You have a good Easter too
