          Haven't posted on here for a while so thought I'd do a quick update, the very account which has recently been past to Lowell: they have said they are awaiting a copy of my CCA from very and will be in touch when they have it .... That was around 3 weeks ago!!! My lloyds and loan and overdraft have been sent to different companies. I have had around 20 letters in the last month all just stating the same. Do you think it's time to send F&F letters as these are enforceable to finally try and get it over with or is it too early?

            HELP NEEDED: ok so received a letter on Saturday from Lowell stating "your original creditor has provided us with the attached reconstituted copy of the credit agreement you entered into with them, which they confirm you would have signed prior to the granting of credit to you. Under section 77/78 of the Consumer Credit Act of 1974, we are not obliged to send you an exact copy of your signed agreement. We are permitted by those sections to provide you with a reconstituted copy of the version you would have signed." then they just go onto say that I need to make payment. What should I send?? Also, any ideas on whether f&f's should be considered to lloyds now?? Thanks.

                Where do Lloyds come into things? Isn't this Lowell?

                No, you should not make a F&F - I wouldn't anyway!

                  Sorry Lloyds is separate, I have overdraft and loan with them which is enforceable.
                  Lowell is for Very Shop Direct.

                    Try and stick to one post per account as that helps us to understand things and not give incorrect help....

                      No, I would sit back and wait for now - are you even in a position to make F&F's?

                      What are the balances of the debt and what could you manage as far as F&F goes..?

                        Sorry, can understand the confusion. I stopped all payments around the end of last year (if I remember correctly). I have an overdraft and a loan with Lloyds both of which were taken out after 2008 and I was informed on here they will be enforceable so I stopped payments with an overall view of offering F&F's to pay it off. they have both been passed to different companies. I have received around 20 letters from these companies all
                        Just basically saying to get in touch to arrange a payment plan. Just wondered whether they might accept F&F's yet??

                          Sorry just seen your other reply, my overdraft was 2500 they stating 3000 now with fees added on an loan is 3300. I could muster 1000. Don't know what they would accept.

                            You might be better to sit tight with Lloyds for now, you say you have had lots of letters, can you confirm who the current owner is ie those currently chasing you?

                            But for now, I would leave it - they won't take a grand, it's too little...... but in time, this is dooable

                              Just been going through all the paperwork (there's lots!!!) one was passed to wescot and one to apex credit but didn't realise they have both passed them on to solicitors. Oops! One is HL solicitors and the other is Nelson Guest and partners solicitors!!
                              How the hell I missed that I don't know, must of
                              Opened them, thought it was same rubbish and filed away. Should I be worried???? The one that wescot passed on just says limited period offer but the other says notice of pending legal action.

                                Can you clarify, wescott regards the catalogue account have sent the pending legal action? You need to send the letter as linked to above - do that asap.
