Unenforceable CCA with Very catalogue, help needed

    Received a letter from NDR today (re: UE Very account) asking me to contact them urgently regarding my account. Same old same old ...... Just wondering if I should send the Creditor won't accept UE template???

    Unsure as read on other posts people being told NOT to do this but on another few posts particularly regarding Very / Shop direct a few people have sent the above and received good responses??? As always, any advise much appreciated.

      If it was me I Would just ignore see what they send next...........

        I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

        If you spot any spammers, AE's, abusive or libellous posts or anything else that just doesn't feel right then please report them to me as soon as you spot them at: webmaster@all-about-debt.co.uk

          Received a letter from "scm solicitors" regarding my lloyds loan. It reads:

          We are instructed by lloyds tsb who advise us that despite several reminders your account remains out of order. This letter, therefore, makes formal demand on you to repay the balance as quoted above less any rebate, which may be due in respect of settlement within the agreed term of the loan. Our client will provide full settlement details upon request.

          If payment is not received by our client within 14 days from receipt of this letter, legal proceedings may be issued against you without further reference. Once proceedings have been issued, you may be liable for the legal costs incurred. In order to avoid this action you should make payment into a lloyds tsb branch. Alternatively you can send a cheque to blah blah blah.

          You are advised that it is our clients intention that information relating to your failure to pay will be lodged with the following credit reference agencies: experian ltd, equifax and call credit. This information will remain on record for a period of 6 years.

          Our client tells us that you should also be aware that it is common practice within the finance industry for this information to be used when assessing your ability to manage your own finances and it may be that this will also effect anyone with whom you might share a joint account. Furthermore we are instructed that if the debt is settled within the prescribed period this fact will also be recorded, but will not lead to the original default being removed.

          If you are unable to pay the full balance, our client may be prepared to accept a reduced sum, together with realistic proposals for regular monthly payments. You must telephone our client immediately on blah blah if you wish to discuss such an arrangement.

          REMEMBER THIS IS A FORMAL DEMAND PRIOR TO THE COMMENCEMENT OF LEGAL PROCEEDINGS AND YOU ARE STRONGLY URGED TO MAKE IMMEDIATE PAYMENT TO AVOID THE ABOVE ACTION"


          So do I need to reply with anything or just ignore?

              Just had a quick read of the template letter but is that not for UE? This account is enforceable, I'm waiting in the hope that they sell it on so I can offer f&f.

                    That's why i2d is asking if you're blagging it.

                    You're sending that letter to make them think it's unenforceable, then they may sell it on quicker.

                          Received a letter from NDR which says:

                          You have failed to respond to repeated requests to pay in accordance with your agreement.

                          Our client is about to issue a statutory default notice on this account which will request full payment of your areas within 14 days. Failure todo so will lead to us registering a default with the credit reference agencies which may affect your and those you are financially associated to, ability to obtain credit from other lenders for 6 years.

                          Shall I respond with anything? This is the account that is UE.

                              Ok so since the last default threaten letter from NDR, I've now received a letter from them stating they can't get in touch with me and they have added a £12 charge to the account, and that it's essential for me to make a payment to prevent any further action. Y don't they just default me?

                                Havent heard anything for a while but Received a letter today regarding UE Very account saying debt has been assigned to Lowell portfolio. A letter from them reads:

                                Your account was sold to us on 22/06/12 because an outstanding balance remains blah blah blah .......

                                Before selling your account Shop direct have checked their records and can find no reason why this should remain unpaid we therefore request yo repay the debt immediately blah bla blah .....

                                If you do not repay this account we will send it to our debt collection department Lowell Financial ltd to recover what you owe, they could use the courts to help recover this debt or decide to send it to a home visit agency who will come to your house blah blah blah ....

                                What shall I reply with????
