Unenforceable CCA with Very catalogue, help needed

    I really need some help after looking at my credit report.

    1.
    Name Miss*R*D Date of Birth ######### *
    Terms 6 @ £ 186*(Monthly) Status Settled
    Current Balance £ 0 Start Balance £ 1,113
    Credit Limit £ 0 Default / Delinquent Balance £ 0
    Start Date 25/11/2005 Date Updated 06/09/2006
    Date Last Delinquent * Date Satisfied 21/08/2006
    I have no idea what this is, don't recognise the amounts or dates?????

    2. The details for my current loan state terms are 60 months @ £95 even though I was paying £150 a month from start date of the loan June 2008 up until September of last year????

    3. Also neither my loan nor very catalogue are stated as defaults they both state arrangement to pay, I'm assuming this is bad because I know its on file for 6 years so surely the quicker they default it the quicker it will come off??

      Why? It will not matter to you for 6 years - forget it and save your cash!

      Raise an online dispute - however first, who is the lender/creditor etc?

      yep they will stop reporting AP (Arrangement to Pay) when it defaults, i.e. when you've missed 3 or so payments..... so in a couple of months.

        Used experian free credit report

        The creditor is black horse finance.

        So do you think the 95 a month is a mistake. Just been thinking, original loan was 5000 over 5 years. Repayments of 150 over that term = 9000!!!! Surely that can't be right???

          do you have a black horse product? ie car, conservatory, glazing, loan etc?

                    don't worry about the amount or anything just yet! Its not important and no, forget settlement right now as it's not long enough down the line to be considered for a good settlement.

                    It varies, generally I aim for 10-20% tops based on the DCA buying the debt (total assignment) for between 8-12p in the £1.

                      These amounts would tally for a £5k loan with around £700 interest......

                      did you have PPI? this may be the missing difference between the amount on the cra to the amount you paid or its an error.....

                          Didn't have PPI, specifically remember guy on the phone asking what I would do if I couldn't make my payments and I said my dad would pay them!!! But that was my thoughts. What do you suggest I do? Would it be worth seeing if they did add PPI?

                            Nah it adds up.

                            You said it was £5k loan. That's right. The cra data is wrong. Don't worry about cra entries right now as things will change a bit.

                            Basically give it 3-6mth then check again and I'll talk you through fixing the errors.

                              Hi, finally received a reply from very "shop direct finance" which reads:

                              Further to your letter I confirm that we have provided you with the following in our letter dated 15th August 2011:

                              1. A re-constituted copy of your credit agreement that was sent to you at the time of opening your account; and
                              2. A copymofnyour current credit agreement, which includes all applicable contractual variations and amendments that have taken place since your account was opened.

                              We have therefore satisfied your request in accordance with the Consumer Credit Act 1974.

                              According to records the current outstanding balance is £4329.36 and an amount of £934.44 has become payable but remains unpaid.

                              If there are any overdue amounts on your account please contact us on 0844 822 4090 to make a payment, as failure to do so could have a detrimental effect on your credit file.

                              If you are experiencing financial difficulties we can also discuss what payment plan options are available to you based n what you can reasonably afford. We will consider your case sympathetically and positively and we will take into consideration all debts that you may owe to other lenders or other commitments you tell us about.                               Terms and conditions
                              You agreed to make payments every 28 days in accordance with the terms of the relevant catalogue. We also issue statements every 28 days requesting the relevant amount from you.

                              I'd the fore like to take this opportunity to remind you that such payments must be made in order to avoid a default charge of £12 being applied to your account and a notice of default being sent to certain credit reference agencies

                              So which letter should I reply with? The letter I sent was sent to NDR not very so is it normal for them to pass it on? And should I reply to very (shop direct) who I received this reply from? Thank you.

                                Your very account is UE isn't it? You don't need to reply with anything.
