So that they'll have something else with which they'll disagree?

Yes, as the sales jerk to whom you spoke probably got commission on PPI or, at least, an extra food pellet reward in his Skinner box.

Re: Unenforceable CCA with Very catalogue, help needed

Just a quick update still haven't made any payments to Lloyds (or obviously the UE account to Very) and have now cancelled my DMP. I received a letter from lloyds last week asking for a new expenditure sheet and another adding £200 in interest and charges ( they have added over £1000'since started DMP last August and I only paid off £300 from Aug till Jan). Do I just keep on ignoring them and hope they sell it on soon? How long do they normally take to sell the account and how long after do you normally wait to send an F&F?

Ok after reading some other posts looks like they sell after 3 months and default after 6. So guess I'm looking at around July time before they default account. Means July 2018 my credit report may look ok

The lloyds accounts aren't UE, it's only the very account that is.

Re: Unenforceable CCA with Very catalogue, help needed

Ok so I've received four letters in the last week from lloyds, all exactly the same but with different dates: basically says at top IMPORTANT YOU SHOULD READ THIS CAREFULLY
Which part of the agreement have I broken? Blah blah blah
How have I broken it? Blah blah blah
What will we do if you do not correct the breach: we will refer your account to our solicitors and they will claim what you owe us through the courts blah blah blah.
They all came with an enclosed information sheet regarding DEFAULT.
This is the account that is enforceable and I am waiting for them to default in the hope that eventually they will accept an F&F.

So: 1) is this an actual default or just a scare tactic?
                  2) do I need to reply with anything or just keep on ignoring?
                  3) what's the actual chance that they would take me to court?

Thanks for any help in advance.

Also received a reply to a letter I sent them last December, where I asked if they could stop all interest and charges on the account and they have sent me an expenditure form to fill in which I am planning on putting in the bin??

sounds like 4 defaults? all for the same account?
                      just file em away

and no, don't send them an i&e, nosey buggers, they just want to beat you about the head with it.

Unless the letters contained certain information and be presented in a form prescribed by section 87 of the Consumer Credit Act 1974 (link) and the regulations appertaining thereto, they simply will not be valid.
