    As you recently responded to Equidebt you do not need to respond to this latest letter at all. It has obviously crossed.

    Just await a reply to your letter dated 5th Nov.
    I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

          I've got an old Cap1account now with Lowells,balance is only £123 but not paid since June 2011.They send me the odd letter then go quiet for months. Sent the F&F template offering £50. They sent an e mail saying they'd accepted my offer but when i opened it properly they've accepted £1 per month

            Is it enforceable? Enforceable old Crap One agreements are rarer than FP posts without emoticons.

            Why are you making them offers? Even if it was enforceable, you should be able to blag it for £123. Every time you make an offer like that, you restart the limitation clock and give them more time in which to be a bloody nuisance.

              Appreciate what you're saying but events and bad news over the last couple of weeks have completely freaked hubby out. Getting an account settled last week gave him such a boost that with this being so small he wanted another debt settled and gone. Things will settle again soon i hope but right now his health is such a major concern that with having 2 court claims recently he's just wanting stress limitation.

                Like I mentioned on another thread this is a head vs heart thing.

                In the head it doesnt make sense to settle but the heart sometimes needs it more.

                Just as each debt is different each one of our circumstances is too.

                Take us for example. Small debts relative to most on here but its a worry to OH.

                We have 3 year old defaults but been paying right up to now so no SB for 6 years.

                Have one CCJ one EN one UE and one isnt sure what its doing.

                Not sure for our level of debt I would want the OH to suffer 6 years of grief just to say I saved £20

                So maybe UE gives me more ammo in a F & F. That sorts our situation out but many members would say thats silly paying anything. It wouldnt be if our life is free of the leeches for good.

                Thats the heart side of things.

                  Thanks for the replies. I'm not clever enough to pick relevant bits out to reply to, but the head and the heart part does sum it up Ken and Flower, you're right £123 isn't worth fretting over. Still worth a cheeky offer though

                            Received a letter from Co op today giving notice of assignment to Lowells. This was originally a debt for £900 in 2003 when we went on a dmp ne 2011with CCCS,as it was then, until 2011. I've not got all the statememnts but the account went to Frederickson's in 2009 along with 2 other small accounts. According to my dmp staments all accounts had a zero balance when we stopped paying it. The accompanying letter from Lowells today states that before selling the account,Co op have checked their records and there is no reson the account should remain unpaid.Can you advise me please?

                            8/2/13..Letter from Lowells stating last paypent was for £121 in Nov 2011. Need to prove its been settled. Confused as we would only have paid £10pm at most when on dmp and we stopped paying in June 2011
                            23/3/13Letter from Lowells...as we are unwilling to pay they will obtain copy of credit file and possibly work details
                            08/06/13..Passed to Fredericksons
                            20/06/13 Letter from Freds. Do not ignore!
                            28/06/13..Letter before action received
                            5/7/13..Letter from Bryan Carters..Pay within 14 days or will recommend clients issue proceedings without further notice
                            19/7/13..Letter from Lowells. Despite letter from Bryan Carter still not paid. One last chance before they issuing a claim. Prepared to accept a f&f settlement if we ring within 48 hours

                              Write back and simply say "The reason is because nothing is due"...
