    10 loans/credit cards - 3 confirmed UE, 3 recon/copy received, 3 not received a CCA reply, 1 might be enforceable

      Yep, me too, although before finding Niddy would have probably have tried to take them up on the offer . Now much better and just file these lovely letters, one day (in about 5 years time) will have a HUGE bonfire

            Moorcroft are back onto this CC, said on 6 Jan the account was on hold and today letter in IMPORTANT INFORMATION - POSSIBLE LITIGATION, basically same letter we got on 18 December from them. Normal threats about 'may' have no alternative etc

            What do I send out this time? Thanks Niddy

              Ok Niddy, that is diary up to date. The site looks really fab, can't believe how much time and effort you have put in.
              Well found out what account they have been phoning for. It is Lloyds Account No 1, had been with Rob Way but they have passed it back to Lloyds. They are sorry we have complained, never complained but oh well, another department is dealing with the CCA and will be in touch soon.

              But they are asking if the settlement figure we gave them back in 2009 would still be possible, as they declined it back then but might look at it now - fraid not we had a little bit of money then and offered all creditors some in a F&F. Four accepted our offer so afraid that money is long gone.

              Nice of them to reconsider after nearly 2 years Will wait and see what 'the other department who specialise in CCA's' come back with

                had the same with lloyds Mrs, also "other department" looking at CCA, they sent us £25 for our complaint, no idea why but I banked it anyway!

                    Morning Niddy, I did send out that letter to Apex about the Lloyds Amex card. Got a response today from Lloyds.

                    'Unfortunately, we don't feel able to agree with your complaint..... set out in some detail how we have complied with section 78 of the CCA.

                    As stated in our letter of 28 June, under section 78 we have no obligation to provide you with a copy of the signed agreement. However, for the avoidance of doubt, we enclosed such a copy along with your requested section 78 documents. We are not obliged to provide any further documentation, nor will we do so.

                    Given the contents of you letter, I am concerned that you may be obtaining advice as to your legal rights from a third party or internet web site, which is incorrect (how dare they diss Niddy). If followed, it is entirely possible that this will cause you to breach the terms of your agreement (did that a long time ago ).'

                    They go on to tell me I have had the card for a while and used it and therefore my agreement is valid and enforceable. They view my account as enforceable and will treat it as so.

                      Ive seen a few of these, worry not - just ignore it.

                        Yea they are making you think about offers cos they probably know the account is UE - Muppets!!
