    Letter 1) Regarding Cahoot loan to tell them that it's still not enforcable.

    I have now had a response for letter 1, explaining that they cannot accept my offer of payment!!!

    Do I bother to reply and tell them that they are muppets?
    I'm currently concocting a letter to Santander to say

    On XX/XX/XX I sent you two letters, one reference: xxxxx, the other referernce :::

    Then on XX/XX/XX you sent a letter to me, which was referencing one letter, but actually detailing the other.

    Can I suggest to go back to the two letters and send me a correct response!!

    Or something similar!

        I've also told them to stop calling me on my mobile telephone!

        I was a bit daft, when I spoke to them last, I got them to change the mobile from my work one ... and stupidly gave them the right mobile number, and not one of my spare sim cards!!!

        ProTip: Get a PAYG sim card, when advising companies whom you don't wish to speak to of your new mobile number, give them the PAYG Sim number. Keep it in your phone just in case they need to contact you to verify the number. After that, put your usual sim card in, and forget about them calling you!

          16/05/2011[COLOR=#0000ff] Following conversation with Paul, have spoke to Santdander and they have removed Finance Marker ... so I can now sell the car, and be able to offer Santander a regular payment. To be arranged shortly! Santander confirmed that they would not sell my debt to a DCA.

          25/05/2011 Letter - Recevied in Post from "Anglia" Collections.
          27/05/2011 Sent Anglia an email saying "Debt sold while in dispute", "no doorstep visits", "Do not harass me" ... "Refer to original lender"
          23/06/2011 Crikey time has flown since last update. I've not heard back from Anglia, so preparing a letter to send to Santander making an offer of reduced payment. Emailed Paul to see if he's had chance to check the Default Notice before I go ahead and post the letter, as if served incorrectly the default can have an impact!
          15/07/2011 Letter - Recevied in Post from "Anglia" Collections.
          15/07/2011 Sent Anglia a copy of previous email saying "Debt sold while in dispute", "no doorstep visits", "Do not harass me" ... "Refer to original lender", and told them to re-read it!

          Another letter from Anglia Collections today. I printed out my previous email where I told them the debt had been sold while in dispute, and that I didn't authorise any doorstep visits.

          I then added a new covering letter explaining their new letter was same content as their previous two, and to refer back to Santander!

          Santander still calling frequently ... Ignored!!! When they finally write a letter to me, I'll start making the token payments, since it's actually enforceable. But I'm trying to get them to cancel the debt if I hand the car back!

            25/03/2011 Scanned and sent the above CCA letter to Niddy!
            30/03/2011 Niddy says: Send off ---> CCA Query - Missing Prescribed Terms
            31/03/2011 CCA Missing Prescribed Terms sent to both Cabot and Barclaycard, 1st Class Recorded.
            09/04/2011 Letter from Barclaycard - Again stating that the debt is legitimate and they don't have to provide a full CCA, scanned and about to upload.
            09/04/2011 Letter received from Cabot - Stating that they haven't received the CCA from Barclaycard and they recommend I continue paying even though they've marked it as Unenforcable!
            15/04/2011 DMP cancelled - Let the barrage of letters begin!
            15/07/2011 Letter received from Cabot - Notice of Arrears.[/COLOR]
            15/07/2011 Sending letter back to Cabot saying Creditor refusal to accept UE
            Just received a letter from Cabot with "Notice of Arrears".

            They've previously acknowledged that it's UE, although Barclays still think it is. I'll fire a letter back to Cabot saying "Creditor Refusal to Accept UE"

            Edited the letter slightly to state that they had previously agreed it was UE, and that it's Barclays who continually argue. I referred them to their letter!

                      a day later than planned, but I've gone through everything and made a concise list of stuff. I'll be updating it in a moment, but here is the breakdown:


                      Barclaycard Premier:
                      18/07/2011 - "Failed Arrangement" letter from Cabot.
                      25/07/2011 - "Statement of Account" letter from Cabot. Recd 29/07/2011
                      26/07/2011 - "Our response to your correspondence" letter from Cabot. Scanned/Uploaded. Recd 29/07/11
                      ... It seems that Cabot have not received the CCA from Barclaycard despite asking several times. Shall I just ignore until I get anything else?


                      Santander Consumer:
                      13/07/2011 - "Notice of Impending Action" Santander. Scanned/Uploaded. Recd 16-23/07/2011 (During vacation)
                      22/07/2011 - "Demand for Full Repayment of the Outstanding Amount". Scanned/Uploaded. Recd 29/07/2011
                      22/07/2011 - "Thank you for your recent complaint" from Santander. Scanned/Uploaded. Recd 29/7/2011 Talking about Policy ?? Confused!
                      I'm really not sure where to go with Santander now. This is for the personal loan for the car. It is enforcable, and I'm trying to make an arrangement to pay ... albeit at a greatly reduced rate!


                      Santander - Abbey - Cahoot:
                      13/07/2011 - "Default Notice" from Santander. Scanned/Uploaded. Recd 16-23/07/2011 (During Vacation)
                      ... it seems they have responded to my letter which mentioned that they were quoting one account but talking about another ... by serving me with a Default. I guess they've realised that the Cahoot account isn't enforcable and getting ready to palm it off to a DCA.


                      Barclaycard Platinum:
                      18/07/2011 - "Response" letter from Barclaycard. Scanned/Uploaded. Recd 19-23/07/2011 (During Vacation)
                      ... Barclaycard responding to my letter "Failure to Accept UE", and stating that none of my points are valid.

                      I'll create a few posts in my usual update style, for continuity.

                        15/06/2011 Letter received from Santander (dated 9th June) - Finally a response to the CCA Request. Interestingly despite the letter being dated 9th June 2011, one attachment was dated 13th June! Uploading
                        17/06/2011 YELLOW Letter received from Santander (not dated) - Saying urgent give us a call on this number. I didn't!
                        17/06/2011 Santander called me on my work mobile. I agreed to call them back. They removed my work mobile from their contact sheet, and replaced it with my personal number. (was a bit slow, should have given my "free sim" number, as I never answer that one! She asked me to start making payments. I explained I'm still in dispute with it, she was fine
                        24/06/2011 Letter Sent: CCA Query - Creditor Refusal to Accept UE Status
                        27/06/2011 Letter received from Santander (Dated 24/06/2011) - They've apologised for last agreement sent, and have found my actual one. Shame it's still not enforceable!

                          08/02/2011 Received letter today from Barclaycard saying "We acknowledge that we have received your request under S.78. We will respond to you as soon as we can!"

                                Oh, in other news ... my ex has struck up a new relationship, got pregnant within a month of knowing him ... and has just had the baby. So, unluckily for me, she now loses her Tax Credits, and I have half nursery fees again!! Grrr.
