    That letter is very intimidating.
    My site name is after General Tutts who won a famous battle at Newbury many moons ago 1643 - I hope to win all my battles and will fight to the bitter end.

      I've read that letter Patch. How can they possibly "obtain your work details" from a Credit Reference Agency? Silly Lowells.

      What they will be looking for is to establish whether you are a homeowner hence the reference to checking if you having a mortgage which will actually show on your CRA file. Since you're not a homeowner (you rent) there is no point in them serving you with a statutory demand. This leaves them with the court option but only if push comes to shove. However since the debt is over £10k they'll also know that they will be at risk of legal costs if they don't win so they may be reluctant to go down that route if they can bully the money out of you first.

      The letter doesn't set you a deadline such as 14 days so it's not LBA but nevertheless it needs an answer. Someone on here will tell how to reply so sit tight and try not to stress, which is easier said than done I know

          Thank you all.. yeah we rent, I run a small business from home and hubby has a low paid job.

          I have recently (with the help of a relative) paid off the Barclays Bank account overdraft (the account would show as paid for from another persons account) and with the payment protection refund for the Tesco card we paid that off and closed it too.

          I feel confident about the last CC's as they are all way before 2007..... This 'was' but it was renewed in 2008 when we needed a bit more money to help us move and they sent a motorbike courier round for me to sign something.... and I do indeed have a copy of my signature they sent.

          Niddy has all the documents relating to this though.

          If they could just accept a grand or two as final payment then I am sure I could ask my relative again... they have offered me the money as they recently came into some unexpectedly due to a bereavement and I was due some but I said no as I thought it would impact on my debt fighting...

              It is isn't it. Like a stern Headmaster who shouts one minute about how stupid you are and then softens his voice to say "But you have potential, it's such a shame to go down the bad path" and makes you feel guilty and then shouts at you again...

              I have PAID that debt more than once over the years... I just want them to feck off.

                It also categorically states that if the court route is taken that any costs will be added to the debt. This is factually inaccurate and misrepresents the legal position as they are making a mighty assumption that:

                1) The court would find in their favour
                2) An award of costs would be made and added to the debt

                So not only does it breach FCA rules but also the code of conduct of the Credit Services Association that Lowell proudly state to be members of.

                  Is there a template letter that says all of that above?

                  I was wibbly after getting the letter but now I am cross that they KNOW they are in breech of guidelines and making up bull and yet deemed it acceptable to send it to me?

                  And.. I STILL haven't been sent the missing terms!

                      hmm not so sure.. I do actually owe 'someone' money... well I dont as the payments I have made since 2005 more than cover it but I guess legally I still do... *shrugs*

                          8th March letter dated 5th March arrives.. Reply to my CCA arrives, no signature. Copy sent to Niddy. UE must send MPT
                          26th March letter dated 19th March from Mercers DEFAULT...
                          27th March sent MPT
                          28th March missing PT signed for by STARTIN
                          3rd April letter dated 28th March arrives, no mention of MPT but saying they will pass debt on.
                          10th April letter dated 1st April saying they have replied to my query regarding MPT pay up.
                          29th April letter dated 23rd April saying Despite our efforts, you need to call us, may be passed on to local DCA, may call at your address, call us now

                            The lowells letter from last week (sorry catching up) - please clarify WHEN did you last send a cca request off and to whom did you send it?
                            I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

                                OK so it went a little like this...

                                CCA signed for 5/12/13

                                Reply to CCA request - 13/12/13 (letter dated 11/12/13)

                                They've contacted HBOS - 28/12/13 (dated 23/12/13)

                                They are still waiting for the agreement and wont write to me again until they have it - 03/01/14 (dated 30th/12/13)

                                7th February CCA recieved with my ruddy signature on... grr

                                10th February sent forms to Niddy.. I feel sick :-(

                                10th February got statement of account letter from Lowells

                                11th February as feared, Niddy says it is enforceable but has asked for more details as it is a preference account,

                                12th Feb missing PT sent via signed for.

                                14th Feb missing PT was signed for

                                14th Feb letter arrived "We regret you've not paid, call to prevent action being taken" dated 11th Feb

                                12th March text message to my mobile saying I must call them.

                                13th March letter from Lowells saying they have replied to my request... they haven't, they didn't send MPT

                                14th March I send letter saying oiy.. missing PT bitches and stop calling my telephone!

                                15th March above letter signed for by BOND

                                20th March.... no more telephone calls since 15th.. nice one!

                                29th March letter dated 21st saying we have sent everything, call us and arrange to pay us.

                                12th April letter dated 9th April saying we have replied to your query, pay us now.

                                28th April letter from Lowells saying you still haven't paid, we are going to dig about in your credit file and come after you.




                                So they have ignored the fact I sent them a letter on the 14th March reminding them they havent sent any terms...
