    That sounds like good news to me, especially since I see you/your Husband sent a CCA Request to Vanquis in March 2018 and the credit agreement they produced then looked unenforceable (did you send it to Niddy to check?).

    If you had ignored their 'Letter of Claim' they would have issued legal proceedings, so at least you've dodged that bullet (for now anyway).

    Fingers crossed Lowell can't get anything more meaningful from Vanquis including a compliant Default Notice.

      Yes dodged for now, so like Warwick said we can have a bit of breathing space, thank goodness,.. yes cca was checked by Niddy, maybe UE... will post up if hear any more, waiting on Sar back from Vanquis.. thanks.

        Well if the credit agreement Vanquis sent you was thought to be unenforceable by Niddy then Lowell may not have much luck with their efforts.

        The main thing is you now have some breathing space so enjoy it

          Hi, just had the SAR back from Vanquis (sent digitally) they had a bit extra for the CCA that they didn’t send originally, so have sent that off to webmaster today . It also shows a default notice and a date they used Rob Way and date sold on to Lowell. Will just wait and see what Overdales send. Or is there anything I need to do now, Thanks xx

            Since Lowell has not responded to your CCA Request this debt is currently unenforceable.

            Vanquis' response to your CCA Request was deemed unenforceable by Niddy in March 2018.

            Don't worry if another document was subsequently produced by Vanquis in your SAR. What matters is whether Lowell can produce a compliant credit agreement when they don't necessarily have access to your data held by Vanquis.

            If you send it to Niddy for checking make sure he knows it came from Vanquis not Lowell.

                    Hi, had good news yesterday, Cabot can not comply with the CCA , they sent letter saying it unenforceable until they do and cannot proceed with legal action,,, hope that means Mortimer cannot continue with the Letter of Claim I sent,, will post if hear anything from Aqua SAR or Mortimer ....

                      Long may that continue

                      I personally have never had nasty surprises from cabot i.e. when they say they can't find the agreement it stays that way.

                          That is very good news for you.

                          Unless I've misunderstood things, you sent Cabot a CCA Request in March 2018 and they didn't comply with that one, in fact they didn't send you anything at all.

                          Let's hope that happens again this time.

                              For now I would keep hold of it - I would hope MC will look at their records before they do anything else. In any event at the moment it is unenforceable

                                If your aim is to avoid a court claim then I wouldn't ignore that letter from Mortimer Clarke since they may well issue a claim because they have already sent you a Letter of Claim fairly recently.

                                You've sent a s77-79 CCA Request to Cabot who have sent you a letter in reply saying the debt is unenforceable at the moment.

                                Mortimer Clarke may not know that or may not have checked the file to see if Cabot have made them aware.

                                My suggestion is why not send Mortimer Clarke a copy of Cabot's letter with a simple one-liner thanking them for their letter and "please see attached".

                                If Mortimer Clarke do then subsequently issue legal proceedings you'll have evidence that their client (Cabot) knew (by their own admission ) that the debt was unenforceable.
