    Hello mate - not your dodgy memory - just haven't got round to scanning in the documents and sending them to you yet, lots of things going on. Will ping them over to you and let you know when I do.

    MKRR did call my mobile today so suspect will get the next nasty letter soon.

    We can try and help get it written off -

    First of all, if there is no trace of this alleged debt on your credit reference agency files, it is either someone else's debt which those numpties have concluded was incurred by you just because you have the same surname, or it is over six years old and may thus be time barred by section 5 (link) of the Limitation Act 1980.

    Is it the same address as that given on either of the alleged twue copies of the agreement?

    Have you ever resided at that address?

    It has to state the nsne of the alleged debtor and the address at which they resided at the time the agreement was made; if you have never lived there or if they've got your name wrong, then they've cocked it up completely.

    I'd say so, but I do doubt that you'd really have enough there to ask the Court of Protection to get the jerk at MKDR certified as a loony.

    I''d not bother about sending them a template letter, as the FCA rules appear to be rather stricter than the "guidance" from the Office of Faffing and Twaddling, and any letter sent to MKDR should reflect the fact that they do not seem to have the least idea or proof that you did incur the debt.

    Any ideas on this? If memory serves I remember seeing a template letter to send if a CCA had wrong address/name on it (or was this a Niddy special?) but can't find it now.

    Am I showing my hand too early by pointing out that both CCA and statements have an incorrect address on them?

    Ok MKDP have finally got round to sending me a reconstituted copy of the alleged CCA. Except I think they are on extremely dodgy ground here as they have sent me TWO copies, one that has my address on it, another that has the details of someone with the same surname as me but a completely different address.

    The copies of statements that they sent me also have a different address on from that which I've lived the last 8 years.

    So this begs the question - how can an accurate reconstitution of an agreement be made?

    Do I have grounds to dispute this on the fact?

    A CCA request will be going off tomorrow on this. Will be interesting to see what they come back with considering that on the majority of the statements that they have sent me is the wrong person!

    Ok this is an interesting one - so far no CCA has been produced, however all they have sent is a bunch of statements.

    However............. most of the statements I have never received, this is because that the address that is on the statements is not mine, it is an address 100's of miles away. I'm thinking Barclaycard have screwed up big time with this one. Will be interesting to see what/if any CCA they send and what address details will be on it.

    Whats the view on their chances with this - is having statements with the wrong address on it sufficient to challenge an agreement, balances etc?
