    Hmm so BCW must be getting desperate now - received a text from a couple of days ago - not sure how they got my mobile number, suspect some other scumbag DCA has shared that little nugget. Also have a letter from them offering a 40% discount.

    I'm tempted to send them the sharp rebuke I sent to ArcEurope a couple of years ago which made them sell the account faster than a hot bun, but also don't want to offer them any encouragement either!

    That much is very true! Its quite a unique situation that they have with this one, there is no way that they can now prove that they have a 'true' copy so theres no way I can see it being enforceable, the only thing thats playing on my mind is that MKDP/Keynes have been very trigger happy recently on sending out claims even those that are obviously UE.

    It is indeed, a couple of months, maybe three, is a good chunk of the SB date. I've got approx 18 months to go though still.

    I like being in the 'too difficult' pile

    My only concern is that they're trying to sidestep the issues to progress this to court. Guess I can't worry about that too much because if thats what they want to do they'll do it anyway.

    I think you might be in the "too difficult to deal with" pile

    10 weeks is quite some time to put it on hold

    how long until it's SB?

    I think you'll go back to the beginning of the process at the end of the ten weeks with a new lackey and you can go through the whole process again, that's if they come back at all, the "too difficult" might not be a bad pile to be in

    Hi All

    I need some help/suggestions on how to tackle MKDP on this one.

    They have sent me a 'final response' which basically states that they believe I am making an allegation that the account is fraudulent, and that I must report this to Barclaycard. They have suspended the account for 10 weeks, after which they will resume collection activity.

    So basically they have completely ignored my point, which is they have failed my s78 request to provide a true copy of the agreement (as they have provided two agreements, one with incorrect name and address details), and instead are ducking the issue by trying to refer me back to the OC.

    So whats the best approach here? I'm thinking that I reply to their 'final response' along the lines of the above stating they have ignored all of the issues complained about but have responded under a false belief), but also that as the debt purchasor they not only purchased the rights but also the duties from the original creditor, therefore its inappropriate to refer me back to the OC (depending on type of assignment, which this letter would also hopefully tease out of MKDP).

    Anyone do it differently?

    Thanks Nanna - well a couple of other creditors have already picked up on the change of address so shouldn't be too difficult for them to do the same. While the are using Firstsource Advantage, and only providing a postal address in India, they're not going to get much correspondence from me anyway!

    Well well - AMEX have finally registered a default with the CRA's after many many months of 6 month late payment markers. I also notice that they have the status of my account as 'Gone Away'.

    Now I have changed address, and mail they have sent me is being forwarded to me - question is do I write to inform them of my new address incase they try to get a sneaky court claim in?

    Or, do I let sleeping dogs lie and let them trace me to my new address (which shouldn't be too difficult - Lowells nailed it within 2 months!)

    Thoughts?

    Yeah they did, but they did not state that 'no further action would be taken'. I've moved house, and I noticed that they have my new address (which I did not inform them off), so suspect that something on my credit file may have altered and a flag has been raised with them.

    Will be interesting to tackle them again, as the enforceability issue I argued was different to the usual s61/77/78/79 approach as I challenged them on unfair relationship provision with regard to charges.

    But........... all in good time, happy to play the long game on this and drag it out again.

    When Lowell previously closed the accounts, did they send you letters confirming that no further action would be taken against you? If so, I would hit them with those.

    Well this is an arse - for some mysterious reason, Lowells have reopened 4 of the Shop Direct accounts that they had previously closed and restarted the whole collections cycle.

    So looks like back to square 1, and step 1 of the UE process - first letter to go will be the 'prove it' letter and see if I can drag this out another 2 years.............

    Typically depressing and cynical behaviour from DCA's - have seen an increase in activity the last couple of weeks as Christmas draws near. Same every year, but shows their ethics that they increase the harassment levels when they suspect that people may have been putting some money aside.

    Well MKDP still unable to resolve my dispute. Problem they have created for themselves is they have sent me documentation that relates to two different individuals. I'm hoping that this will be fatal to them now as they cannot credibly state that they can provide a true copy of any agreement that may have been entered into........
