                at the start of this journey i owed
                £52000.00 UNSECURED £5000.00 SECURED
                £0000.00 secured debt as of 17/12/2010 fingers crossed
                on 14/07/2012 i now have £32.000 unsecured and £15.000 unenforceable [thanks to niddy and aad ]
                as of 17/03/13 its now £26K AND £15K UE
                ITS COMING DOWN SLOWLY WHILE STILL ENJOYING MY LIFE

                      Well I'll be stopping paying so I expect I'll get a few letters to start with!

                      None of my creditors have my phone number, though Capquest somehow got hold of my work number at one point so I expect I'll get a call from them. I know how to deal with this lot though so I'm not worried about that.

                      I will start a template letters section as and when I receive them too so everyone can see the standard fluff that the DCA's send out.

                          So the fun and games has started already! Had a letter today stating the following:

                          "This account has been passed to us as a bad debt as our client has been unable to obtain payment from you.

                          We wish to make it quite clear that unless the full balance is paid to us within the next 10 days, we will pass your account to our Solicitors, with instructions to issue court proceedings"


                          So, I'm not a solicitor, but as far as I was aware, if this DCA are referring to their 'client', and depending on the type of assignment of the debt, then only their client can take me to court, not the DCA.

                          Do I understand this correctly or am I mistaken?

                          The account is in dispute anyway, so they will be getting a response to this effect but was wondering on peoples thoughts as to the wording above.

                            you understand it perfectly well mate but they won't do anything, they never do! I'd not worry, I wrote back to the same guys and simply returned their letter with "unknown" - they then went away!
                            I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

                                Coolio, though their pet solicitor Trevor Munn I understand has been known to ignore CPR and try to issue claims through Northampton Bulk Claims.

                                So far though:

                                'Notice of Assignment' sent by email, no letter.

                                No Default Notice received (though they sent me an email claiming one had been sent).

                                One step at a time with this lot though!
