    22/2/2013 - Letter from Black Horse stating account has now been passed to Mackenzie Hall
    21/3/2013 - Letter before action from Mackenzie Hall
    21/3/2012 - Double whammy to MH - Missing Prescribed Terms and Sold In Dispute
    As above - sent MH a response with a double whammy of template letters. Will wait to see how they respond.

    Hi All

    Had a 'letter before action' from Mackenzie Hall today. This is the first communication I've received from them. I've attached the letter below as it seems to have some real intent about it although I've noticed the following:

    1) They are not the creditor - Black Horse is

    2) They have only allowed 7 days between the date on their letter and the date they have given me to pay. With time its taken to arrive in the post this has gives me 2 days to pay I don't think could be considered reasonable

    3) They state that 'may' lead to legal action

    4) There is the presumption that judgement will be granted, not may be granted

    5) There is presumption that once judgement is granted that they can go on to enforce attachments of earnings etc.

    All in all its a letter that breaches quite a few guidelines!

    I was thinking of responding with the 'sold in dispute' template as the agreement BH have sent it still missing prescribed terms.

    Its Apex mate.

    A totally bizarre DCA. Some of the codswhallop coming out of Stratford beggers belief.

    I read where one poor guy just got an envelope. Nothing in it. Bizarre behaviour.

    And that was all he got in a year. One envelope no correspondence. Thats really gonna make you cack yourself.

    No wonder they got taken over by Cabot but suspect some of the less clever monkeys were kept on.

    How utterly bizarre!!

    Get a letter today from Lloyds TSB stating that my account has been passed to Apex Credit Management for collection.

    Contained in the same letter is the introduction letter from Apex.

    This is EXACTLY the same as the letter they sent on 17th October last year so not really sure what it is they are trying to achieve here!!

    My last letter was very clear I was not making a s78 request. In fact I actually stated "This is not a request under s77-79 CCA, please do not mistake it as such".

    I guess I was expecting too much of a DCA to read plain english

    I'll re-iterate my last letter but in simpler english (one syllable)

    Letter received from Apex below. It appears that both Apex and Lloyds TSB are incapable of understanding plain english as I made it clear I was not asking for a copy of a CCA.

    I think I will write back to them making it clear that I am asking for their client to fulfill their obligations under s.74 of the CCA1974 and also the Consumer Credit Regulation 2010.

    I'll also state that if their client continues to mistake my legitimate request for a s77-79 CCA request then I will consider this a deliberate act of ignoring their obligations and no further correspondence will be entered into until they provide the information requested.

    What does everyone think?

    They are being as stupid as Capquest really as they are calling through the main reception and asking to be put through to me so their calls are recorded (Capquest tried to deny that they had ever called me!).

    Once they get the UE letter though then hopefully that will be enough to make them realize they are on a lost cause anyway

    Advise them that you are not allowed personal calls at work and insist that the number is removed. Mention the OFT guidance.

    Thanks everyone. Looks like they have fingers in lots of pies. Well they're not going to get much traction if they're going after accounts that are UE where a creditor has admitted they can't find the CCA!

    We were looking for these guys back in December so as you say seem quite new. Belfast address I think we concluded and they are a global outsourcing outfit with debt collection just a small pat of their interests.

    Dont recall much more than the assignment notice tbh. So same boat as you.
