    This is why I thought it would be useful for Niddy to have a look and see what he thought of the agreement.

    If he can find something that we can use to challenge these agreements I'm hoping that the PDL industry could be blown out the water until they get their acts together.

    30/10/2012 - CCA sent to Niddy for review
    Just sent the CCA for this account to Niddy to get his views on it. Agreement to my laymans eyes seems a bit different to a standard credit card agreement, so I'm hoping that some expert eyes will see serious flaws in how its been put together.

    Think its a method of getting the unwary to forget the rules and reach for the phone in a moment of panic that you have a deadline to meet.

    Which of course any normal rational human being would realise you would not meet.

    They are having to be much more clever now they know we can request contact only by letter and hence a full audit trail.

    We had Apex write a good one where the complaint was about phone harrasment and us wanting it all in writing.

    At the bottom of the letter saying they would stop phoning they put something along the lines phone us in order to set up a repayment shedule.

    All nice and fluffy to the unwary but just a method to get you back onto the phone threat cycle.

    Well bit of a letter frenzy today - several letters sent off

    What I like is the ridiculously short timeframes that these companies demand you contact them in (e.g. 7 days) which is totally insufficient when taking into consideration postage times etc.

    I spoke to a solicitor a couple of weeks ago and they are now recommending to clients in disputes to allow 21 days when requesting a response as a couple of recent court cases had ruled that 14 days had been insufficient time.

    Not sure how relevant that is to consumer credit disputes but does give food for thought.......

    Theres a few that I haven't CCA's, mainly the Shop Direct as they were post 2007 and the Payday Loans.

    Main reason is I have been waiting for them to start the correspondence, and have left sleeping dogs alone!

    then update this one on a page so that we can see where we are with it, when did you send the CCA?
    what did you get back?

    Have you still others that you haven't CCAed? It's a big part of your protection ftom a quick trot to court so if I were you I'd get them all off, if you have a letter saying they have no paperwork, get it off to them toutsuite, they will drop you and it will be on to the next crowd of diddie, some of ours are on their 7/8th DCAs

    Company House Registration Number: FC027527

    Looking on companies house website this company was converted/closed on 18/5/2010 and has not submitted any accounts since 2008.

    However their CCL is still "Current"

    So my question is can they legally supply loans if their CCL is registered to a company that has not filed accounts in 4 years and has a status of converted/closed?

    Should this go to court I am wondering if this could be part of my defense?

    I'm wondering what should be my next response?

    No neither did Albion or Wescot.

    I'm not sure what they're trying to achieve by doing the DCA merry-go-round when they have already written stating that they can't find the agreement as it makes them even more impotent than they already are
