Send any correspondence to the C.E.O. Mark Brunault @ Capquest, and a copy to Ms A. SIMMS, Quality & Control Officer.

If the person calling me claims that they have received no correspondence requesting they do not call me at work this will incur an additional £10 charge.

I think I could justify this on the basis of preventing me from carrying out my duties, the considerable effort in answering their calls when they have been asked to put all correspondence in writing etc.

I'll then invoice them for their calls, and when they don't pay I will start court proceedings against them.

At least thats my thought atm!

21/7/2012 - Letter received from Wescot, failed to maintain payment plan arrangement
2/8/2012 - Letter received from Wescot. Pretty much same as letter of 21/7/2012

Sent OD CCA Request - allaboutFORUMS - View Single Post - Overdrafts - CCA Information
21/8/2012 - Doorstep threat response letter sent
14/9/2012 - Letter received from Wescot. Account suspended pending investigations

Now I know for many this is old news but I have only just read this post from Niddy regards O/D's:

allaboutFORUMS - View Single Post - Overdrafts - CCA Information

This is really interesting (excuse the pun) as my O/D was well over its limit, having been placed that way by Santanders own charges.

Now that would be a little poetic justice if their own charges mean normal rules will now apply!

29/10/2012 - CCA Request sent to UCA
    6/11/2012 - Letter from UCA

Letter received yesterday from UCA. Its possible that they crossed in the post with my CCA request as they were dated 30th October.

Basically content of the letter goes along the lines of:

We are disappointed you have not responded to our repeated correspondence blah blah (1 phone call & 1 letter is repeated correspondence?!!!)

We may have to refer the account back to our client

We will recommend to our client that they commence legal action

    blah blah

I expect Amex will farm this out to an external DCA shortly.

Thanks Vint - I think I will ignore. They have obviously not read the letter correctly, or alternatively they have a limited amount of keys on the threat-o-matic response machine so do not know how to handle it and have sent me the closest one that suits!

24/10/2012 - Letter from ArcEurope, Statement of payments, and Credit Agreement
29/10/2012 - Response back to ArcEurope that account still in dispute
30/10/2012 - CCA sent to Niddy for review
3/11/2012 - Letter from ArcEurope, account currently on hold, referred back to their client
Looks like my letter back to ArcEurope has had the desired effect as they have placed the account on hold and are waiting on instructions from Quickquid.

Quickquid are in a couple of breaches of the CCA, but I have not told them exactly what it is they have done wrong.

I'd like them to ask me - because I will charge them a consultancy fee for telling them what they are doing wrong!

Despite the fact that it clearly states that Halifax are in breach of the CCA request sent to them and it included a copy of the letter from Halifax stating they cannot find the agreement!

I think I will ignore this letter for now and see what garbage Capquest send next.
