    6/10/2012 - Letter from Wescot that they have established I live at my address and they may take further collection activity
    24/10/2012 - Letter from Nelson Guest & Partners Solicitors
    29/10/2012 - CCA Request sent to Wescot
    1/12/2012 - CCA response from Wescot
    3/12/2012 - CCA sent to Niddy

    Word back from Niddy is no prescribed terms so currently:



    19/12/2012 - Missing Prescribed Terms letter sent to Wescot
    5/1/2013 - Letter from Wescot - Account is on hold
    14/2/2013 - Letter from Nelson Guest & Partners Solicitors
    22/2/2013 - Letter from Black Horse stating account has now been passed to Mackenzie Hall
    Well looks like Wescot have thrown in the towel on this one

    Letter today from Black Horse:

    Your agreement has now been referred to Mackenzie Hall Ltd to act on our behalf for collection of the overdue amount. Any further payment or contact regarding your agreement should now be made to:

    Well I don't see Mackenzie Hall getting any further than Wescot did!

    I've not had dealings with this bunch before (though have read plenty about them), so considering that Black Horse have already stated "to act on our behalf" I'll be interested to see if they misrepresent their legal position when it comes to threatening court action!

      It was great to get that letter as SD probably were one of the most cynical of creditors when it came to bumping up the charges and balance over a long period despite knowing I was in financial difficulty.

      Irony is that if they had played ball and been reasonable when I contacted them it would never have come to this and the balance would probably have been paid off by now.

        That's what I find so weird too- if creditors were more flexible they'd probably still get paid off, albeit a bit late, as opposed to upsetting us with their tactics and so get sod all!

          Hi All

          Looks like Capquest have thrown in the towel on this one as I have received a NOA from Halifax:

          Dear SnV

          As we haven't been able to agree a suitable repayment plan, we've transferred your IF Credit Card to a debt collection agency (DCA). We've instructed Firstsource Solutions UK Limited to arrange collection of the outstanding amount.

          Also included in the envelope was an introduction letter from Firstsource Solutions.

          Well as I have a letter from IF confirming they cannot find the agreement they are going to get short shrift from me!

          I'll be sending them the 'Letter previously confirming no CCA' and let them suck on that:

          I've never even heard of 'Firstsource Solutions UK Limited'. There certainly seems to be very little on the usual forums after doing a quick google search so looks like a new 'player' is trying to enter the market.

              There are a couple of members on here who have heard from them. Think in relation to Lloyds OD's. But for the life of me cant remember which members it was.

              We were looking for these guys back in December so as you say seem quite new. Belfast address I think we concluded and they are a global outsourcing outfit with debt collection just a small pat of their interests.

              Dont recall much more than the assignment notice tbh. So same boat as you.

                  Thanks everyone. Looks like they have fingers in lots of pies. Well they're not going to get much traction if they're going after accounts that are UE where a creditor has admitted they can't find the CCA!

                    Well looks like I will have to send the harassment at work letter, and no CCA received letter off to First Source Solutions asap.

                    Had a phone call from them today at my place of work bunch of numpties. Looks like Capquest have not passed on my letter to them of 29/10/2012.

                      That's what I would do S&V.

                      Advise them that you are not allowed personal calls at work and insist that the number is removed. Mention the OFT guidance.

                        They are being as stupid as Capquest really as they are calling through the main reception and asking to be put through to me so their calls are recorded (Capquest tried to deny that they had ever called me!).

                        Once they get the UE letter though then hopefully that will be enough to make them realize they are on a lost cause anyway

                          9/2/2013 - Letter from HL Solicitors. It is EXACTLY the same as the letter they sent 3/1/2013 word for word!!
                          12/2/2013 - Sent letter pointing out that request not made under s77-79 of CCA1974 and to comply with my request
                          7/3/2013 - Letter from Apex Credit Management stating that as its a current account no CCA available
                          Letter received from Apex below. It appears that both Apex and Lloyds TSB are incapable of understanding plain english as I made it clear I was not asking for a copy of a CCA.

                          I think I will write back to them making it clear that I am asking for their client to fulfill their obligations under s.74 of the CCA1974 and also the Consumer Credit Regulation 2010.

                          I'll also state that if their client continues to mistake my legitimate request for a s77-79 CCA request then I will consider this a deliberate act of ignoring their obligations and no further correspondence will be entered into until they provide the information requested.

                          What does everyone think?

                                My last letter was very clear I was not making a s78 request. In fact I actually stated "This is not a request under s77-79 CCA, please do not mistake it as such".

                                I guess I was expecting too much of a DCA to read plain english

                                I'll re-iterate my last letter but in simpler english (one syllable)
