    Yes I know I've been pretty bad at getting them sent off, just been concentrating on the ones that I've had 'active' communication from.

    Lowell are in a bit of trouble with this one though. Over half the balance is made up of charges. When Shop Direct have applied charges because, I quote, "they could not contact me by phone", I think I could argue that these are unfair charges........

    But you're both right I have been naughty

    I'll get the CCA request sent off asap

    Another letter from Lowell stating that if I do not contact them they may send the account for doorstep collection, or they may take me to court. There is also a mild threat of petitioning for bankruptcy if I 'qualify'. Hmmmmmmmmm.

    I've not sent a CCA off for this lot yet, definitely next letter for me!

    So fired this off to Capquest as they have completely missed the point of the previous letter. Have framed it as a formal complaint so will see if this provokes a more sensible response. But I won't hold my breath...............

    Thanks both. This does seem to the way these people operate, issue a claim and hope to get a default judgement.

    Well hopefully when HC and Capquest realize that their client has already admitted that they cannot enforce the debt, then this should put them back under the rock that they have crawled from.

    I was taken to court by Howard Cohen BUT that was an enforceable debt (too new to be UE) and for a lot more money than yours SnV.

    Standard stuff but be careful HC likes to litigate by default. There are quite a few of us victims of him before we found our way here.

    I wouldnt treat as run of your mill rent a head.
