I think I would wait and see what they send next, at the moment they are trying to send you round in circles, why waste the postage?

        Hi everyone, me again

A letter from MKRR, as follows

Despite previous correspondence from us in which we have made offers to agree payment solutions that suit your finncial circumstances you have not made full payment or arranged a payment plan.

Owing to this we have no option but for your account to now be transferred to Keynes Collections for litigation consideration to resolve this on our behalf. Any further actions that are taken mat result in additional fees and charges being applied to your account.

In order that we may reach an acceptable outcome you need to contact us without delay as in 7 days time the escxalation team may take appropriate further action.

PLEASE CALL US AS A MATTER OF URGENCY.

So they have ignored my reply regarding their silly LBA letter, theyv b een phoning a couple of times a day for the last few days as well, but iv ignored that.

I think il send a short letter referring them to my request for documents,, as I have informed MKDP I will only correspond with MKRR, I shouldnt ignore it.

Your views would be appreciated, reply or ignore and wait for Keynes to get in touch.

        Thank you

        Regards Fredbare

              Hi everyone

Sent the letter to mkrr referring them to previous correspondence. I have received two letters back, both delivered the same day, one from keynes headed notice of intended legal action 10 march and one from mkdp 13 march stating they cannot resolve my query, they take great care blah blah and they will conduct a thorough review and liase with OC, they will let me know the outcome.

The letter from keynes quote pre action protocols, they have been instructed by mkdp to collect the outstanding balance in accordance with my agreement,!!! They state I had an agreement with OC which I defaulted on and breached the agreement!!! which has now been terminated,. They state that within 14 days legal action may be taken without further warning.

MKRR are still ignoring me and have not responded to my request for documents. MKDP are replying to correspondence sent to MKRR.

I know I must take the letter from keynes seriously although I think my letter to MKRR crossed with theirs,

Should I send keynes the reply to an lba?

                  Hi Deepie

                  Thank you for the link.

MKDP were very quick to inform me this account is not covered by the cca 1974 as it was a current account and therefore no agreement is available, keynes on the other hand are claiming there is an agreement which will be used for litigation purposes.

I never received a default notice for the account, only a final demand, and they closed the account.

Can the letter you linked me to be used for an overdraft wholly made up of bank charges and interest? Is ADR something to do with mediation? Sorry for the questions Deepie, but i dont want to do anything wrong here and im in a bit of a panic.

                  Thank you again

ADR is alternative dispute resolution (service).... don't worry about that.

How much is owed on this, and how come it is "all" charges...? Please try and elaborate and make me understand things and I'll try help you send a reply.

Up to date, I cant believe its been 3 years since they started this nonsense, if they had accepted my offer of monthly installments in the beginning instead of ignoring my requests it would have been paid a long time ago. I think I will completely ignore this now, unless anyone can advise me further.

Thank you for persevering. hope I spelt that right.

                      Hi Niddy

The above is what happened up to Feb 2012. The account has been passed around various people since Feb 2012 and then sold to mkdp in April 2013. The current account was opened in 1994, I abandoned the account in Nov 2009, the account was closed by the bank in may 2010. The bank refused to help me, I was refused bank charge reclaim Dec 2009, three days later they raised the interest on the overdraft, They were offsetting ALL my income to their charges and interest before paying any DD's which took me straight back into O/D and more charges, I had enough and transferred my income to another bank, and abandoned the account in Nov 2009 owing 1480.00, all charges and interest. I did make an offer to pay early 2010 which the bank ignored.

Please ask if there is anything else i should tell you.

                      Thank you so much

                              Hi

                              An update

Received letter from mkdp regarding the breakdown of the alleged balance for my hsbc account, they say I have already been sent statements of account and if I wish to go back further to send a sar to BARCLAYCARD, gave me address and told me to make cheque payable to Barclaycard LOL. They obviously used the wrong template and filled my details in on the top. Dont Ms Taylor check these before signing and sending them out.

Have heard nothing from Keynes regarding my reply to their lba, will update when I do.

Will appreciate suggestions on what to do about mkdp, reply or ignore, offer a full and final, I dont know, their like leeches, cling on and wont let go, their adamant I sort it out with hsbc myself.

Thank you in advance for any suggestions.
