    Asked if they could change payment date as I was finding it difficult to pay on a 4 weekly basis. Request refused and charges were applied. Stopped paying and ignored. Various letters came from their arrears dept also ignored.

    December 2011 letter from reliable telling me an appointment has been made to contact me at my home on wednesday? No date.

    Sent letter to reliable asking who they had made appointment with as it wasnt me.
    The name of the agent who had made the appointment. What was discussed. Date and time appointment was made. Also told them no doorstep visits everything in writing.
    No reply to that except a nice letter wanting to help me. Why couldnt they do that in the beginning?
    Sent cca letter
    Received a True Copy of agreement and transaction history.
    Few more letter from reliable, conduct unacceptable etc
    Received notice of potential court action.
    Letter from Tocatto April their acting on behalf of jd williams. They also noted a pound was paid into the account in Jan. This was the pound I paid for the CCA and was reversed back out, its in the transaction history.
    I have not replied to this yet.

    Niddy says unenforceable send account sold in dispute letter
    Sent letter

    Received another letter from tcatto giving 7 days to pay or recommend court action, home visit etc. I looked for these people, other site says they are part of lowell. Phone calls have started again too.
    I Would send them this------->Threat by Creditor - Threat-o-Gram Letter Before Action

        October 2010 Complaint sent to ICO for non compliance of sar, informed HSBCOctober 2010 Letter from HSBC, sorry I was dissatisfied, SAR was sent to me and can escalate my concerns if I want to

        December 2010 Letter from DG saying Bank had sent final response and enclosing an income and expenditure sheet to fill in for repayment proposal, ignored
        January 2011 Letter sent to DG advising still in dispute and asking for original facility letter

        February 2011 Letter from CDR, referred for immediate collection, ignored
        February 2011 ICO requested more information, sent them copies
        March 2011 Letter received from CDR we will be calling you on xx date please call usignored
        April 2011 Final Offer of a discount from CDR
        April 2011 Letter from CDR Despite previous reminders etc, no option but to take further action and enclosing a standing order mandate to pay monthly?
        May 2011 Sent letter to CDR, no doorstep visits, writing only, account in dispute
        May 2011 ICO not upheld my complaint, HSBC complied and to ask the bank direct for the facility letter as it wasnt in my original sar and they didnt have to provide it, and HSBC wanted clarification on what a faciility letter is?
        May 2011 Letter from Metropolitan in reply to my letter to CDR in May, apologising, no doorstep visits will be made, telephone details removed etc

        February 2012 Letter from CDR, payment overdue??? imperative to pay within 24 hours, please telephone us
        May 2012 Letter from CDR, another generous offer of a discount, upon receipt cra files will be marked as satisfied. Thought they had sent a final offer letter in april, oh yes they did!

        Up to date, I cant believe its been 3 years since they started this nonsense, if they had accepted my offer of monthly installments in the beginning instead of ignoring my requests it would have been paid a long time ago. I think I will completely ignore this now, unless anyone can advise me further.

          Received letter from westcott advising their collecting on behalf of hsbc and to get in touch if any queries. Should I respond to this? advice welcome. Thank you

            If it were me I'd just wait until I heard from Westcott and then send Our Templates | Unenforceability Templates | Account Sold whilst in Dispute

                Letter received from Tocatto. They have completely ignored the letters I sent anf have passed the account to third party Carringtons? They will access my account and consider further steps. They will obtain copy of cra file. Then go on to advise about court action, bailiffs, charging orders, attachment of earnings (they'l be lucky) and bankruptcy. I have tried to find info on the net about carringtons and have found a firm called dallyn & co based in carrington retail park manchester. Cant find anything else about them, never heard of them before.

                The letter from tocatto also states possible legal action but they are still willing to accept installments or a full and final offer, if I accept they will stop all action on the account. They have given me 15 days to reply before the account is passed on to carringtons.

                I would be very grateful for any advice on what to do next. Thank you.

                      Well if you don't go through security and hang up they cannot harass you by phone, if they do you just send them the template letter or give them the free number from Niddy, as for letters they will try to frighten you by using BIG RED LETTERS but what else can they do, all you need to do is post the gist of the letters here and see what people advise. They like to sound nasty but they have no more rights than any of the others!!

                      Edited to add, I suspect if they knew you had Niddy (and Paul) behind you that THEY would be a lot more scared than they will make you!!

                        Thanks for that, I wondered if anyone had heard of these people, cant find anything about them. I monitor my phone calls, I have a different ringtone for people I want to speak to, havent spoken to any dca or bank in over two years, if they get on my nerves which isnt often I turn the volume off, and yes I agree with your comment about Niddy and Paul, I wish I had found this site sooner. Thanks again

                              Letter receuved from jdwilliams. They cannot trace an executed agreement and accept they cannot legaly enforce. They are ceasing all collection activity but have made it clear that they will continue to update cra files for six years as the components of the debt is undisputed.

                              In this case however they are prepared to cease all collection activity and have notified tocatto to do the same. They trust this closes the matter.
