  • Daughters accident at work

    Ok most of you will know that 5 weeks ago youngest daughter was in an accident, while on the works mini bus that picks up disabled children and takes them to school. (no children were involved)
    the KA driver that hit them head on has taken the blame, all ok so far, now the fun begins
    The insurance for the bus is in our employers name, BUT, the insurance company kept insisting that they couldn't talk to him only the driver Mr x as it is his policy.
    when he finally convinced someone that as the bus is registered to his company and he has the policy for it in his name,that the driver and passenger assistant are his employees and wanted to make a claim, they said it was being sorted and would get back to him to let him know what was happening.
    we then received a call from swinton insurance saying that a company of solicitors called Silver beck would be dealing with the claim for Mr x and daughter, I pointed out that Mr x was not daughters father, just her driver at work "we'll sort that out" someone will call to go over the papers,
    15 mins later someone called asking to speak to Mr x I again told them he doesn't live here.
    then someone called to make an appointment the following morning to fill in the paperwork and get the ball rolling, they came, she signed and things went a head
    last week daughter go an appointment with a physio and went for her 1st appointment on sat.
    today gets a call from our boss.
    he hadn't heard a thing so went into swinton office in town he was told there that his solicitor is a totally different company to Silverbeck and that they know nothing about the damages claim that has been started and we have to cancel all physio appointments, the New solicitor will be sending papers out and we are to start again.
    all hell has now broke out and we are getting calls from every one telling us that it's all fine and things can go ahead, but the boss is insisting that we don't.

    anyone have an Idea how these things work?

    It's a long road NW

    I do know that MrD had a very small bump when we were on holiday last year. He accepted responsibility, phoned the insurance company and thought everything was sorted (most damage was our car).

    After that I got about 20 calls from various claim companies trying to get me to sue MrD for my accident, one even sent papers with MY Name on them. We never reported it to the police as it was so minor, no one was hurt,other car was fine (it was a bloody great jeep so our car just bounced off). Everytime one of these numpties phoned I asked who told them there had been an accident, they couldn't tell me. I phoned our insurance and bollocked them and lo and behold the calls stopped.................so who knows? it's all a complete scam from beginning to end

      I was wondering if the insurance company think they are suing our boss (because they were at work) and not the other driver.
      then giving him a solicitor to sue the other driver for his losses, bus is a write off and he had to pay another company more than he was getting from the council to do the school run as the numptys at the insurance company thought you could fit 3 electric wheelchairs in an Octavia!

        After a lengthy talk with Silverbeck, a daughter sobbing her heart out, and hearing that our boss wouldn't listen to the nice young man from Silverbeck trying to explain what had happened and to sod off as he had had enough.
        I have told daughter that she is to stay with SB and phoned the physio to get her appointments reset up.
        she is now making herself sick worrying that, the boss will start on her.
        He goes through ME.

            feeling sick.

            she has pain in her lower back, she thought that now she had started the physio it would be a help, then the thought of having to start over with the claim again was going to be a hassle, she just broke down in tears, so Mum to the rescue.

                  Oh, what a nightmare for you and your daughter, NW.

                  One of my little homilies is that we never stop worrying about our kids, it is just the nature of the worry that changes ....

                          Only just seen this NW. Give your daughter a Pixie hug too xx

                          I had to deal with Swinton for my youngest daughter...they were a bloomin nightmare. Luckily there were no injuries to complicate matters.

                          I hope the physio starts working for her soon though I know it can take some time. When I had lower back problems I went through allsorts of treatment until, finally, traction sorted it.

                              Sorry to hear about the accident.

                              Back attacks can be very painful and go on for ages if misdiagnosed or not treated properly, so you should insist on the physio and any referrals that they offer. Also take not of all the times you visit, and the length of the visit, the prescription charges, the receipts for medication such as paracetamol, the events you need to cancel, the probles with washing hair etc, and the charges for the hairdresser, albeit Mum's time.

                              I dealt with SB many years ago and they stretched it out being very nice, but did not get the £00000s that some promise. So do not spend any monies until you have them. That said, the medical charges are separate items and the personal injury costs do depend on the amount of time suffered and the severity, which could be permanent.

                              I had a company car and my accidents were in the company car on company time, so we should have been insured by the company. However, that was for the car only, any personal injury claim had to made to another recommended firm, who could not really care. The only work related 'benefit' was time off sick and for appointment, although when you are paid for 37 hours and work 60 without overtime payments they had more swings than we had roundabouts. In reality, those accidents (not my fault) were work related injuries and should have counted for more than just a referral to a solicitor, and I think, but am unsure, there may have been some recent change to the legal process which would hold the employer to some extent responsible.


                              Should you wish, you could employ your own solicitor to fight your case e.g. Accidents Are Us, as you are suing the driver of the KA in your own right. However, as one appears to be appointed already, it may be easier to go with them. Often a specialist local firm would be best. SB is a large national company which has a specialist section for personal injury.

                              In your case, you need a letter from SB or the insurance company telling you that they will accept the physio claims. That is important as if you don't get the physio, the opposing solicitors will then say that you made the injuries worse. Sometimes the physio will let you pay at a later date. In many cases, the insurance company will give you a payment for medical expenses in advance of the final payment. However, if you are still not well, do not accept a Full and Final payment.

                              The solicitor for the personal injuries insurance policy is not necessarily the same as the solicitor for the car insurance policy as people are more complex than vehicles (sometimes). The owner of the firm has a duty of care to the employees and has liability for that. The insurance of car driver responsible for the crash pays for the repairs to the car more quickly that they pay for repairs to the people injured, and they will ultimately be responsible for all payments to vehicle, road damage and any people involved.
