Awesome result (dismissal) and another shamefully defeated mbna mob!!
Layman, claimant (mbna) tried to enforce a £15k debt. Defendant argued defect DN (lost); couple of minor cca points (all lost) and most importantly argued the recon provided showed different charges (£20 & £25) plus there was no name and address on the "linked recon" as per Carey v HSBC, and as a result the agreement was deemed unenforceable and the claim dismissed.
