  • Will question

My sister has made her will today and I am the executor and trustee of the will.

Why these things can't be written in plain English I don't know

My name is written when I am named as the sole executor and trustee, then there's various clauses about the trustee powers before a beneficiary section which is leaving tax free amounts to my children.
Then a section after payment of just debts, funeral expenses etc all real and personal property (trustees can sell call in and convert into money with power to postpone etc) then the estate and any ready money called my residuary estate.
My trustees shall hold my residuary estate on trust for my said brother

She basically wants to leave everything to me other than the money for my children if I'm still alive when she dies.

There's more gobbldy gook but the above is the giste of it. Does it sound right ?
I would have thought they could just put the bit about the beneficiaries then say everything elde is left to my brother Mr looking forward
Obviously the solicitor has typed up what she has asked for but I just want to check it's correct for her wishes

She's younger than me and never married so hopefully I'll never have to action it

Oh and inheritance tax, do the same limits apply for brother and sister as they would for parents leaving a will or married couples etc

    Thx

    Re: Will question

As you are named as residuary beneficiary you have been left the remainder of her estate after payment of debts and legacies.

Same inheritance rules as parents but not husbands & wives who can leave estate to each other free of inheritance tax
