    Well example - When they write to you next the first thing you will do is send a CCA request as MMF have a habit claiming the right to contractual interest, therefore obtaining a copy of the credit agreement will establish whether they have a legal right to this (apologies if you've already got this, I can't recall whether you have!)

    They tend not to pay much attention to the previous OFT664 and (newer) FCA CONC guidelines, I really wouldn't worry about things that are hyperthetical, they tend to get more aggressive towards people they think they can bully, and as you're not going to be bullied, should put them on the back foot immediately.

    OK well lets see what Motormile send you next - I wouldn't respond to a notice of assignment.

    MMF are known to not play by the rules, so if they operate business as usual, and with the history of how Sppedloan have dealt with you, I think you may have every chance of having them by the short and curlies.

    I'd do nothing for now and wait until the next letter from Motormile Finance and then we can discuss how you would like to approach things. Some new legislation brought in by the FCA regards charges and interest on payday loans may provide some useful arguments even though they don't apply retrospectively (yet).

    Thanks Elsa,

    SnV, and everyone else has been a godsend, and the help I have received from this site has been invaluable. It has reduced my stress levels on many an occasion. I work, and I don't own my flat. I have never ever filled any of their I&E forms, have one that I sent the other sharks, and my approach has been take it or leave it. I can't give them what I don't have. You can see from this thread, some accepted my offer with a lot of back and forth and others didn't like Speedloan.

    What a nightmare this has been for you. Your thread is an indictment of the hold these appalling sharks have over people.
    Thank goodness for the help and support you've had from SnV and everyone on here.
    I wouldn't presume to interfere, but do you mind if I ask what your circumstances are - are you in work or on benefits, ill or disabled?
    Do you own your own home?
    In any event I would never fill in their own I&E forms. If it becomes necessary I would use the Nedcab one here: https://nedcab.cabmoney.org.uk/quickfs.asp

    I'd not even bother wasting the price of a stamp responding, and you know rule #1 - which is never to phone, and just keep paying what you can afford.

    If they contact you again, or keep bothering you then you can make the effort - but I'd make them work a fair bit more first

    or just write and tell them nothing has changed an you cannot afford a higher payment at the moment.
    they are lucky to get £24 on such a small amount I only pay £100 on a £24000 CJ and £10 on a £2000 CJ give them a £1 and tell them they are lucky to get that amount.
