      •It was Barclaycard from the start.

      •RBS sent default notice (yesterday)

      •Shawbrook and lendable sent an agreement on my email to sign.

      Sorry I wasn’t able to separate posts as I had to work without day off, hope I can do it next week.

        Hi,

        I am posting list of all my debts, please advise how to avoid CCJ and Charging Order? Can I offer all my creditors £5 or £10 a month until my current situation will improve? i am worried and scared

        Any advice and help will be greatly appreciated.

            •Last full payment: £187 on 23/11/2018

            Received from NatWest:
            •1/02/2019
            This notice is being sent to you as requested by the consumer Act 1974 because default sums have levied on the account. (£12)

            •1/03/2019
            This notice is being sent to you as required by consumer credit act 1974 because you are behind with your payment (£197.93)

            •I sent I&E and offered £50 a month

            •7/03/019
            Thank you for your proposal for repayment of the account.

            Account will be closed and interest will not be charged.

            •I called to set up D/D and they requested £125 a month. (Not paying)

              Hi Nik nik, Just Reading your thread and noticed Shawbrook and Lendable have both emailed you an agreement to sign, DO NOT DO THIS, I take it if I am reading correctly they have no signed agreement from you, this can only be a good thing.

                    Hi Nik nik, someone better qualified than me will be along to help, but what I can say is keep posting, you will have the very best help and you are a very very long way away from a CCJ or charging order (if at all). Please try not to worry, we have all been in your shoes, it is scary, but if you accept what is being suggested here, follow the advice and never phone these companies or make any contact without posting here first you simply cannot go wrong. Good luck on your journey, in a few short weeks or months you will get to grips with things and life will seem much easier. X

                        this letter before claim as required by the practice direction on pre-action conduct & protocol contained in the civil procedure rules. This letter constitutes a formal demand for payment of £xxxx and to give you notice of PRA Group’s intention to issue court proceedings against you etch.

                        there is form: you have 30 days from the date at the top of the enclosed letter to fill in and return this form.

                          •01/2019 Sent I&E with £50 offer, they requested 3 month bank statement and payslips, i didn’t send and ignored phone calls.
                          When I applied for loan they didn’t ask for statements and payslips.

                          they sent 3 or 4 letters but i can’t find.

                          •I’m paying £50 a month.
                          •This month paid only £10.

                          •Received CCA Niddy said it’s enforceable.

                          •2020 debt was sold to Cabot and they took me to the court.

                              the payment clause of the agreement provides that you must make the required periodic payment in full by its due date. You are in breach of that clause because you failed to make all your periodic payments in full when due.
                              If you do not take the action required by this notice before the date shown then the further action set out below maybe taken agains you.
                              if you have difficulty in paying any sum owing under the agreement or taking any other action required by this notice, you can apply to the court which may make an order allowing you or any surety more time.

This was because we sent the notices later than required by the CCA. The relevant notice has since been sent to your registered email address accompanied by the FCA Arrears Information Sheet, which is required to be included under the CCA.

                                Under the CCA you are not liable to be charged any interest accrued for the period during which we failed to provide you with compliant notices nor are you liable to pay any default sums (that is any late or missed payment fees, or other related sums that were applied to your account during that period.)

                                We can confirm that you were not charged any default sums during the relevant period but you were charged interest. As we charged you interest during this period of non-compliance, we are crediting you all the interest you were charged during this period, totaling £8.43.

                                1/07/19 I received 3 emails from lendable:
                                Your Lendable account is in arrears. If we do not hear from you today we may send a local representative to visit you as we need to understand your circumstances.

                                12/07/2019 found letter from representative:

                                i gave I’ve been instructed to contact you by our client but have been unable to meet with you.
                                To prevent a further visit please contact our client
                                and then call me to confirm that you have done this.
                                If i do not hear from you I will visit you again over the next few days.
