      NatWest credit card open 2009
      Limit: £8700
      Currently: £8909
      Last payment: £187 on 11/2018
      Default notice sent on 8/3/2019
      Account termination letter on 1/4/2019
      Niddy said it’s enforceable.

      Debt 2️⃣
      Natwest credit card open 2006
      Limit £300
      Currently: £305
      Last payment 11/2018
      Default notice: 15/03/2019
      Didn’t request CCA

      Debt 3️⃣
      RBS credit card(was Mint until 2017)open 2006
      Limit £500
      Currently: £510
      Last payment 11/2018
      Default notice: can’t find
      sent I & E with £50 offer a month but they requested £125
      Didn’t pay since 11/2018

      debt 1 2 & 3 all with NatWest

      Didn’t receive default notice yet.

      this month I couldn’t afford more then £10

      This month couldn’t d afford more then £10.
      Received CCA i guess it’s enforceable

        I always made the minimum payments until 11/2018 then I just lost control of my finances as debts got larger and things went wrong.
        I don’t know where to start or what to do. I don’t want to loose my home.
        Can I offer all creditors £10 a month until things will improve?

        i hope someone can help me please

          Welcome to AAD
          Best to copy each Debt into a separate Post and then add details to each separate NOTE as your Diary progresses.

          You have started to take control of your Life! We have all been down this same path and this first step can be so difficult!
          As you did for the Nat West credit card so do with the rest of the Debts.
          Using the AAD template for a S77/78 CCA request plus £1 for each individual debt.

          My advise right now is not to contact your Creditors other than the CCA request.
          From now on everything in writing so no emails, SMS or phone calls. There are good reasons for this!

              At this time your debts seem to be with the Original Creditors.
              There is a 6 year clock that will have started. Each letter or communication which admits the debt restarts that clock.
              Always refer correspondence back here for the MODS to see and advise.
              Send copies of CCA's received to Niddy (as you did with NatWest) .
              Taking control means of your money and realistic evaluation of each Debt (you will find that these are actually different).

                The credit agreement may appear enforceable but a debt owner has to comply with many other statutory duties.

                This is still with NatWest who are likely to assign it to a debt purchaser if you stop paying. I see they've already terminated the account so see what happens next.

                    Maybe the reason you can't find a Default Notice is because they didn't serve you with one?

                    This could be a good thing if the account is terminated and sold on in future so don't mention it to them.

                      Barclaycard have a reputation of being slow to issue a DN. Don't tell anyone you haven't been served with one yet.

                      Was this definitely a Barclaycard from the start or could t have been an Egg or Monument or Morgan Stanley Dean Witter etc?

                        Send the credit agreement to Niddy to check, but there may be other flaws with the account to look for.

                        Was there PPI involved?

                        Were you sent an agreement to sign after you made your online application?

                          Lendable Loans have a very high interest rate!

                          I'll wait to get a little more history before commenting on this one.

                            Very catalogue account often have problems especially if the account is opened when you make the first purchase but the paperwork isn't sent out till later (if at all).

                            I see you've had no reply to your s77/78 CCA Request sent in April (this year) so the debt will be currently unenforceable. Don't send a reminder in case it makes them try harder to remedy the problem.

                            Hopefully they'll assign the account to someone like Lowell Portfolio.
