                          Today I received a long winded letter directly from LTSB.
                          Below is a small section taken from the letter.
                          "LTSB do not accept that we have not complied with my CCA s78 request, and as far as the bank are concerned the account is fully enforceable, and it is a complete misapprehension that section 78 provides debtors with the right to obtain a copy of their original signed agreement. " This is not what the CCA provides for and, in fact there is absolutley no requirement under under the CCA to provide such a document" So despite claiming to give notice that the account is in dispute, you have given no valid reason to dispute the debt."

                          They go on to quote different court cases including Carey, and others, and basicly say, "so come on pay up or else !

                          Emailed the letter to Niddy for his opinion as to how to respond to this one.

                            "Despite attempts to reach a suitable agreement on the repayment of your outstanding RBS account, to date, the full balance is due in payment.
                            Our clients instructions to us are clear in that under the terms & conditions of the contract you have signed,the full balance is now seriously overdue.

                            Please understand that unless we agree suitable repayment terms with you, we may proceed to complete a pre-litigation report in which the following information must be provided in writing by you:

                            *The full name & address of your empoyer, together with your annual salary.
                            * Your full residential address upon which a court summons may be served.
                            * Details of any properties you own together with the amounts of all prior charges.

                            This is not our preferred course of action but if left with no option we may begin enforcement proceedings against you as our attempts of voluntary solution have failed.

                            Unless we hear from you immediately, we will then progress to gathering the nessessary financial information to support that recommendation while the account remains unpaid and the account unresolved.
