Mackenzie hall - working on behalf of Capquest(disputed mobile phone debt. They set Meritforce on me and I sent them doorstep threat letter. Now its passed to Connect on behalf of Capquest. Have ignored letter demanding payment. Still no agreement.

As it was not a regulated consumer credit agreement, they do not need to send such an agreement as that agreement does not exist. However, the creditor does need to prove that the money is owed and that, if the alleged debt has been assigned to them, that the alleged debt is owed to them.

Cabot - (bank overdraft). Still don't know if they have authority to collect the debt but they told me they don't have to produce agreement and they are right.

No, they're not.

The law has been changed (link and overdrafts are no longer excluded. They now have to comply with section 61A (link - duty to supply copy of executed consumer credit agreement) and/or section 61B (link - duty to supply copy of overdraft agreement) and failure so to do may impair their chances of enforcing the alleged debt.

Currently they are ringing me a dozen times a day (from various different numbers) on my house phone and mobile but I am just rejecting all the calls. Getting me down a bit though now cos they ring at all hours of every day.

It's about time that was stopped.

RBS CREDIT CARD

Start date - 2002/2003
Status - Default put on credit by RBS file October 05.
Balance - £1766.00
Last paid October 2011 through DMP which is now ceased.

Debt sold, unsure how many times. Debt now with TRITON.

3 weeks ago sent full and final without predudice, ex gratia offer, pro -ratered with all other creditors a portion of the £9k my mum offered me. Sent standard template letter but removed any acknowledgment of the debt. I also asked them for a breakdown of payments received over last 12 months.

No response to my letter.

17,10.11 - Received letter from RBS re f&f offer stating they will not comply without a signature.
27.10.11 - CCA Letter sent first class recorded.
04.11.11 - Received credit card statement from RBS
12.11.11 - No reponse at all, now had their 12+2 days to reply
18.11.11 - CCA received
21.11.11 - Emailed CCA to Niddy -
Niddy says
10.02.12 - keep getting the odd statement from RBS but heard nothing else.

Typical RBS; instead of getting something, they arrogantly quibbled and now that it's , they'll get nothing.

Do you know, funny you should say that. I went on last night just to check on the PM's that I got and I noticed that it said Noddy. I thought, how did I find Niddy then?

I think they usually issue a 'Letter Before Action' or a Final Demand before issuing court papers but I'm not sure if it's a legal requirement.

They do have to have issued a default notice though.

Right update time...

BWC/Phoenix/Arrow Global (small littlewoods debt) - heard nothing since they started squabling over who deals with the debt. Still no agreement.

CL Finance (big loan) - they sent CCA and Niddy thinks enforceable. I haven't responded to them since it arrived and they haven't been in contact either.

Debt Managers (bank loan)- heard nothing since sent cca request so still no agreement.

Triton -(bank loan) Heard nothing from since they sent agreement (ue)

Last payment made to anyone was October.. slightly concerned in an odd way that I haven't heard much, makes me wonder what they are up to! Presume they would hit me with demand letters before taking me to court (the likes of Cabot who don't need to produce cca and CL finance who have and it looks enforceable)?

CRA still hasn't removed defaults off my file.. one should have come off in October when it reached its 6 years and the other in December. Don't suppose I can do much about that though!!

If you checked your PMs within the CAG environment it would have automatically changed since I sent it, even old posts like the one where I first found the reference to :niddy changed the word to 'noddy' in the beginning of December, at the time they found out about my PMs and banned me!

I found this site through a recommendation from a member over there who is also a member on here. That person knows who they are and I thank them most sincerely. I wouldn't have found this site but for that private message that was sent suggesting that I check out this character called Niddy. I really don't know where I would be know if they/I hadn't done what they/I did. I wasn't getting much response from my requests there TBF. I came here and I have had nothing but help, at all hours if needed. I thank each and every person who contributes on here. FANTASTIC

I suppose the worries I had with CAG in the early days sprang from my own desire to know in depth what was going on. I started there about the beginning of 2009, and followed through for quite a long time. The more I delved into solving our own problems the more I realised that contradiction, outright falsehoods, and worst of all a party line were being imposed upon the members. Some of whom were ending up in worse trouble than when they started, a typical DMP/IVA et al company problem. From the plethora of phone calls we were getting at that time from CMCs cold calling with something that was too good to be true led me to start digging and digging deep, we had no choice at the time. That bit of knowledge gained told me all I needed to know about what was really happening there.

Now we have, in AAD, a place we can all come, there is only one party line as I see it here and that is to kick as much arse as is pocssible on behalf of our members and users.

I think Pooks, the owner of this thread would agree as well, as they have come a long way from day one of joining us.

Well I certainly feel much better, more confident and not alone since i found AAD. I feel confident to accept advice and use it, the CAG site .. well the party line was even visible to me and i hardly knew the site!
