Hi Niddy, just before I found this site I stupidly offered a full and final of just under 60% (about £600 it was) but they refused and offered me a counter settlement of £900. I have £100 but if I cant go down the CCA route and they have already refused a much higher offer, dont they have all the balls in their court?

    Thanks, Pooks

    Well done...
Aw thank you so much for having a look, im over the moon with the verdict!!

Do I just sit and wait for them to contact me again now? Also.. im a bit confused... if its unenforcable could it still go to court?

They go on to say i have a £1206 balance and a payment plan for arranged for monthly instalments of £5.47.. hmmm not any more! Should I now contact Cabot and arrange to continue paying this privately?

    Thanks, Pooks

These are such darned loose things that it can even be a mention in another letter about something else but nevertheless you should be made aware of the new owner.

You are unlikely to get to see the docs themselves but you could ask them to prove they own the debt and under The Copies of Documents Regulations provide you with a copy of the Deed of Assignment. You will probably get drivel back and all sorts of excuses but it will serve as an NoA so you will know where you are. Then you could proceed as I suggested above in the sure knowledge that are not just acting as agents for the OC.

Thanks Garlok, is there a standard letter I can send or just write to them as per above quoting the regs?

If they don't actually own it by Assignment in Absolute then I would tell them to go and whistle as they could do nothing without the original creditor's involvement. So onwards, if you get them to accept that lower figure, save the difference yourself and in a few months time make them an offer in Full & Final. As a rule of thumb start at the 10% of the outstanding balance and work up in low increments to about 20% (gives them 100% profit on the purchase remember) if they refuse, then take the offer off the table and continue to pay the payments for a few more months and try again. It is more than likely they will come back to the table for a second round at that point stick hard at around 15% and let it rise all so slowly towards the 20 mark again. In the end you are likely to get a 25% settlement I would have thought. Its almost like playing poker.

    Thanks Garlok,

How do I find out if they actualy own the debt? They refused to send me the cca and sent me my postal order back saying they dont have to send it because its exempt from the regulations due to it
    being an account overdraft.

    Regards, Pooks

It's up to you if you want to pay it or blag it. If you want to pay it, then write to them and say you'll set up a standing order to pay £5.47 per month.

Either the email CCA link but make sure you put your user name as part of the subject line so he knows it relate to your diary, or put a thread in the upload your documents part of the forum (main page at the bottom) and add the file as an attachment to the thread. You do that by starting the thread and under the box you type in is a bit that says additional options, one of those is add attachments so just click on it and up load. Only Niddy can see posts in there and you will only be able to see your thread.

I should think that the CRAs are probably just a bit slow. I'd leave it a few weeks then check again.

Regarding the overdraft, the debt is enforceable regardless of cca. Are you sure the debt has actually been sold ie have you had a letter informing you? Debts are often just passed around different dcas but are still owned by the OC. I'd blag this one and then arrange a payment plan or F&F if they come up with legal threats. Just keep us informed.
Hi, I am not sure who actually owns the debt. I know when I first offered the full and final on this (before I changed tack), they replied saying their underwriters had refused the offer but then offered me a counter offer. I will wait until I get some mail from them and then will negotiate a payment plan, they were accepting £5.50 with the dmp on a £1200 debt so hopefully they will agree to keep this as it is.
