    Very good point. I am taking all the help on board and doing it all recorded, the dca thieves are not getting another penny from me!!

    Hi, just read all the posts (and the ones after this).. im a bit thick at times..like its been said, its better to pay the post office for the odd recorded delivery than to keep paying the debt so thats what I shall do!! Just on the subject of SB, I defaulted on all the debts, they are all in arrears, the bits ive paid off them (last payment made in October) wont have brought me out of arrears soooo.... is it 6 years from October of from the true date of the arrears. Seems very complicated haha!!

    I have received another cca today, I have updated my diary and sent it you but had to send it to your address through my hotmail as i cant seem to use the one on here.. not sure how to set up an account!

    I remember on MSE someone waited for *6 years* then applied at the same bank for credit, that she had an old debt for. She mistakenly presumed because her credit file was clear, the debt had become SB (think about this...)

    I responded saying, no - you're wrong because XYZ and got shot down in flames. The poster applied - flatly rejected. A week or two later, the lender (Barclays) wrote asking for repayment of the old debt, the poster wrote back (based on posts on her thread) basically saying "its SB go away I owe nothing, I did, but not now". Hah

    THAT reset the clock as she admitted liability - the worse thing was, it was only 2 weeks wrong..... two weeks was all she messed up with!

    Gutted

    You know her mistake (and those planks on MSE that replied)? They presumed that as the credit file entry had gone the debt "must be" SB'd. I asked why? I knew of loads of accounts that were over 6 years into a repayment plan, thus the default had gone but they were in no way anywhere near SB (they were still being repaid FFS)! I explained as well, that most data to CRA's is backdated and should not be trusted - but the fact the account didn't show, the poster thought she knew best.......

    FP - sorry I wasn't quoting you as if you were wrong, your info is spot on (as is Garloks) - I was only trying to simplify the working out part of it and quoted you, cos you were the lucky one

    Absolutely right FP. The clock starts at the point of the first missed payment if I remember one of Paul's posts correctly.

    Also, if ever anything does go further, you have proof of delivery - it's all too easy for things to get 'lost in the post' as it where.

    Yes but you will find that the advice here is to only send the letters for really important scenarios. Just look at the number of times that the advice is ignore! Cost = nowt

    Ok will do. Just a thought though, if 1 end up sending 2 or 3 letters a month (recorded) to each creditor, at £1.50 a shot and was only paying £1 to £5 a month off the debts, then aren't I better just paying the £1 or so to the debt? Might sound like a silly question I know but if the letters increase, like I expect they will, I could be paying more to the post office than I was originally to the creditors lol

    They're dcas so it goes without saying that the left hand doesn't know what the right hand is doing!

    Date and keep the statement and envelope and ignore. They are in default of your cca request and so just wait and see what they send next.
